SENATE SUBSTITUTE FOR

 

HOUSE BILL NO. 5121

 

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1961 PA 236, entitled

 

"Revised judicature act of 1961,"

 

by amending section 517 (MCL 600.517), as amended by 2009 PA 228.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 517. (1) The sixteenth judicial circuit consists of the

 

county of Macomb and, except as otherwise provided in subsection

 

(2), this section, has 13 judges.

 

     (2) Subject to section 550, this circuit shall have has 12

 

judges during the period beginning 12 noon, January 1, 2011 and

 

ending 12 noon, January 1, 2017. The 1 judgeship temporarily

 

eliminated from this circuit during the period of January 1, 2011

 

to January 1, 2017 shall be the judgeship of a judge who is not

 

eligible to run for reelection due to constitutional limitation on

 

the effective date of the amendatory act that added this


 

subsection.January 5, 2010.

 

     (3) Subject to section 550, this judicial circuit may have 1

 

additional judge beginning January 1, 2017.

 

     (4) Subject to section 550, this judicial circuit may have 1

 

additional judge beginning January 1, 2019. if this new judgeship

 

is added to the sixteenth judicial circuit, the initial term of

 

office of the judgeship shall be 8 years.

 

     Enacting section 1. This amendatory act does not take effect

 

unless the following bills of the 97th Legislature are enacted into

 

law:

 

     (a) House Bill No. 5122.

 

     (b) House Bill No. 5123.

 

     (c) House Bill No. 5124.

 

     (d) House Bill No. 5125.
