Bill Title: Amends the Illinois Vehicle Code. Provides that a person may operate a motor vehicle that has been registered but does not display a current and valid Illinois registration sticker provided that he or she has proof, in the form of a printed receipt from the Secretary, that he or she has registered the vehicle before the previous registration's expiration but has not yet received a new registration sticker from the Secretary. Provides that this printed proof of registration is only valid for 30 days from the expiration of the previous registration sticker's date.

2 | AMENDMENT NO. ______. Amend Senate Bill 2802 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
5 | changing Sections 3-413 and 3-701 as follows:
| ||||||
6 | (625 ILCS 5/3-413) (from Ch. 95 1/2, par. 3-413)
| ||||||
7 | Sec. 3-413. Display of registration plates, registration | ||||||
8 | stickers,
and drive-away permits; registration plate covers. | ||||||
9 | (a) Registration plates issued for a
motor vehicle other | ||||||
10 | than a motorcycle, trailer, semitrailer,
truck-tractor, | ||||||
11 | apportioned bus, or apportioned truck shall be attached
| ||||||
12 | thereto, one in the front and one in the
rear. The registration | ||||||
13 | plate issued for a motorcycle, trailer or
semitrailer required | ||||||
14 | to be registered hereunder and any apportionment
plate issued | ||||||
15 | to a bus under the provisions of this Code shall be attached
to | ||||||
16 | the rear thereof. The registration plate issued for a |

1 | truck-tractor or
an apportioned truck required to be registered | ||||||
2 | hereunder shall be
attached to the front thereof.
| ||||||
3 | (b) Every registration plate shall at all times be securely | ||||||
4 | fastened
in a horizontal position to the vehicle for which it | ||||||
5 | is issued so as to
prevent the plate from swinging and at a | ||||||
6 | height of not less than 5
inches from the ground, measuring | ||||||
7 | from the bottom of such plate, in a
place and position to be | ||||||
8 | clearly visible and shall be maintained in a
condition to be | ||||||
9 | clearly legible, free
from any materials that would obstruct | ||||||
10 | the visibility of the plate. A registration plate on a | ||||||
11 | motorcycle may be mounted vertically as long as it is otherwise | ||||||
12 | clearly visible. Registration stickers issued as
evidence of | ||||||
13 | renewed annual registration shall be attached to registration
| ||||||
14 | plates as required by the Secretary of State, and be clearly | ||||||
15 | visible at
all times.
| ||||||
16 | (c) Every drive-away permit issued pursuant to this
Code | ||||||
17 | shall
be firmly attached to the motor vehicle in the manner | ||||||
18 | prescribed by the Secretary of State. If a drive-away permit is | ||||||
19 | affixed to a motor vehicle in any other manner the
permit shall | ||||||
20 | be void and of no effect.

21 | (d) The Illinois prorate decal issued to a foreign | ||||||
22 | registered
vehicle part of a fleet prorated or apportioned with | ||||||
23 | Illinois, shall be
displayed on a registration plate and | ||||||
24 | displayed on the front of such
vehicle in the same manner as an | ||||||
25 | Illinois registration plate.

26 | (e) The registration plate issued for a camper body mounted |
| |||||||
| |||||||
1 | on a
truck displaying registration plates shall be attached to | ||||||
2 | the rear of
the camper body.
| ||||||
3 | (f) No person shall operate a vehicle, nor permit the | ||||||
4 | operation of a
vehicle, upon which is displayed an Illinois | ||||||
5 | registration plate, plates
or registration stickers , except as | ||||||
6 | provided for in subsection (b) of Section 3-701 of this Code, | ||||||
7 | after the termination of the registration
period for which | ||||||
8 | issued or after the expiration date set pursuant to
Sections | ||||||
9 | 3-414 and 3-414.1 of this Code.
| ||||||
10 | (g) A person may not operate any motor vehicle that is | ||||||
11 | equipped with registration plate covers. A violation of this | ||||||
12 | subsection (g) or a similar provision of a local ordinance is | ||||||
13 | an offense against laws and ordinances regulating the movement | ||||||
14 | of traffic. | ||||||
15 | (h) A person may not sell or offer for sale a registration | ||||||
16 | plate cover. A violation of this subsection (h) is a business | ||||||
17 | offense. | ||||||
18 | (i) A person may not advertise for the purpose of promoting | ||||||
19 | the sale of registration plate covers. A violation of this | ||||||
20 | subsection (i) is a business offense. | ||||||
21 | (j) A person may not modify the original manufacturer's | ||||||
22 | mounting location of the rear registration plate on any vehicle | ||||||
23 | so as to conceal the registration or to knowingly cause it to | ||||||
24 | be obstructed in an effort to hinder a peace officer from | ||||||
25 | obtaining the registration for the enforcement of a violation | ||||||
26 | of this Code, Section 27.1 of the Toll Highway Act concerning |

1 | toll evasion, or any municipal ordinance. Modifications | ||||||
2 | prohibited by this subsection (j) include but are not limited | ||||||
3 | to the use of an electronic device. A violation of this | ||||||
4 | subsection (j) is a Class A misdemeanor. | ||||||

7 | Sec. 3-701. Operation of vehicles without evidence of
| ||||||
8 | registration - Operation under mileage plates when odometer | ||||||
9 | broken or
disconnected. | ||||||
10 | (a) No person shall operate, nor shall an owner knowingly | ||||||
11 | permit to
be
operated, except as provided in subsection (b) of | ||||||
12 | this Section, upon any highway unless there shall be attached | ||||||
13 | thereto and
displayed thereon when and as required by law, | ||||||
14 | proper evidence of
registration in Illinois, as follows:
| ||||||
15 | (1) A vehicle required to be registered in Illinois. A | ||||||
16 | current and
valid Illinois registration sticker or | ||||||
17 | stickers and plate or plates, or
an Illinois temporary | ||||||
18 | registration permit, or a drive-away or
in-transit permit, | ||||||
19 | issued therefor by the Secretary of State; or
| ||||||
20 | (2) A vehicle eligible for Reciprocity. A current and | ||||||
21 | valid
reciprocal foreign registration plate or plates | ||||||
22 | properly issued to such
vehicle or a temporary registration | ||||||
23 | issued therefor, by the reciprocal
State, and, in addition, | ||||||
24 | when required by the Secretary, a current and
valid | ||||||
25 | Illinois Reciprocity Permit or Prorate Decal issued

1 | therefor by the Secretary of State; or except as otherwise | ||||||
2 | expressly
provided for in this Chapter.

3 | (b) A person may operate or permit operation of a vehicle, | ||||||
4 | upon any highway a vehicle that has been properly registered | ||||||
5 | but does not display a current and valid Illinois registration | ||||||
6 | sticker if he or she has proof, in the form of a printed | ||||||
7 | receipt from the Secretary, that he or she registered the | ||||||
8 | vehicle before the previous registration's expiration but has | ||||||
9 | not received a new registration sticker from the Secretary. | ||||||
10 | This printed proof of registration is valid for 30 days from | ||||||
11 | the expiration of the previous registration sticker's date. | ||||||
12 | (c) No person shall operate, nor shall any owner knowingly | ||||||
13 | permit to be
operated, any vehicle of the second division for | ||||||
14 | which the owner has
made an election to pay the mileage tax in | ||||||
15 | lieu of the annual flat
weight tax, at any time when the | ||||||
16 | odometer of such vehicle is broken or
disconnected, or is | ||||||
17 | inoperable or not operating.
