AN ACT

 

amending title 41, chapter 7, article 10, Arizona Revised Statutes, by adding section 41‑1275; relating to the state budget.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 7, article 10, Arizona Revised Statutes, is amended by adding section 41-1275, to read:

START_STATUTE41-1275.  Truth in spending; public notice; definitions

A.  when the budget bill is introduced IN THE legislature, the director of THE JOINT LEGISLATIVE BUDGET COMMITTEE SHALL Calculate AND TRANSMIT TO THE presiding officer of the chamber of the legislature in which the budget bill was introduced a TRUTH IN SPENDING ESTIMATE.  The TRUTH IN SPENDING ESTIMATE must calculate THE AMOUNT OF GENERAL FUND APPROPRIATIONS FOR THE CURRENT FISCAL YEAR plus THE TOTAL AMOUNT OF ALL APPROPRIATIONS FROM ALL other SOURCES FOR THE CURRENT FISCAL YEAR, ADJUSTED BY THE POSITIVE OR NEGATIVE PERCENTAGE CHANGE IN the total PERSONAL INCOME estimate published for the current FISCAL year compared with the total PERSONAL INCOME estimate published for the immediately PRECEDING fiscal year.

B.  IF A standing committee of a chamber of the legislature recommends the passage of a budget bill that EXCEEDS the TRUTH IN SPENDING ESTIMATE, THE presiding officer of the CHAMBER IN WHICH THE committee action OCCURRED, WITHIN TWENTY-FOUR HOURS after THE committee action, shall:

1.  issue TO the chamber's NORMAL MEDIA DISTRIBUTION LIST a press release in the following form:

ARIZONA STATE BUDGET PROPOSAL

NOTICE OF SPENDING INCREASE ABOVE TRUTH IN SPENDING ESTIMATE     

IN COMPLIANCE WITH SECTION 41-1275, ARIZONA REVISED STATUTES, THE   (INSERT CHAMBER)   IS NOTIFYING TAXPAYERS IN ARIZONA THAT A BUDGET bill that EXCEEDS the TRUTH IN SPENDING ESTIMATE, wHICH is DEFINED AS THE AMOUNT OF GENERAL FUND APPROPRIATIONS FOR THE CURRENT FISCAL YEAR plus THE TOTAL AMOUNT OF ALL APPROPRIATIONS FROM ALL other SOURCES FOR THE CURRENT FISCAL YEAR, ADJUSTED BY THE CHANGE IN PERSONAL INCOME GROWTH, PASSED THE   (INSERT COMMITTEE NAME)   ON   (INSERT DATE)  .

2.  post THE PRESS RELEASE IN ITS ENTIRETY IN THE PRESS RELEASE SECTION OF THE LEGISLATure's WEBSITE FOR at least SEVEN CONSECUTIVE BUSINESS DAYS.

C.  for the purposes of this section:

1.  "Budget bill" means the general appropriation bill for the different departments of the state, for state institutions, for public schools and for interest on the public debt, as prescribed by Article IV, part 2, section 20, Constitution of Arizona.

2.  "PRESIDING officer" means the Speaker of the HOUSE OF REPRESENTATIVES or the president of the SENATE.

3.  "total Personal income estimate" means the amount determined and published by the ECONOMIC ESTIMATES COMMISSION by April 1 of each year PURSUANT TO ARTICLE IX, SECTION 17, Constitution of Arizona. END_STATUTE

Sec. 2.  Effective date

This act is effective from and after December 31, 2014.
