services for health and human services programs. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 531, Government Code, is amended by | ||
adding Section 531.0058 to read as follows: | ||
Sec. 531.0058. DIAGNOSTIC LABORATORY SERVICES. Regardless | ||
of where specific laboratory services are performed, or where a | ||
laboratory is physically located, any provider of diagnostic | ||
laboratory services shall be eligible to participate in all health | ||
and human services programs as an in-state provider if the | ||
provider, or its parent, subsidiary or affiliated company or | ||
companies, individually or in the aggregate, maintain diagnostic | ||
laboratory operations and employ at least 1000 persons within | ||
Texas. | ||
(b) This section does not impair the commission's authority | ||
to refuse enrollment of a provider on the grounds that the provider | ||
is otherwise unqualified for enrollment. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2013. |
