| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter C, Chapter 112, Transportation Code, | ||
| is amended by adding Section 112.104 to read as follows: | ||
| Sec. 112.104. ELEVATED HIGH-SPEED RAIL TRACKS IN CERTAIN | ||
| COUNTIES. (a) In this section, "high-speed rail" has the meaning | ||
| assigned by Section 112.201. | ||
| (b) Except as necessary for passenger boarding, high-speed | ||
| rail tracks located in a county with a population of more than one | ||
| million or a county adjacent to a county with a population of more | ||
| than one million must be elevated on pylons to 40 feet or more above | ||
| the ground. | ||
| SECTION 2. This Act takes effect September 1, 2019. | ||
