To whom was referred a Bill (H. 4843) to amend the South Carolina Code of Laws by adding Section 48-39-148 so as to authorize businesses with a deck, dock, or other structure located in a critical area, etc., respectfully

Report:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

 

    Amend the bill, as and if amended, SECTION 1, by striking Section 48-39-148 and inserting:

    Section 48-39-148. Notwithstanding any statutory or regulatory provision of law to the contrary, including any provision of or authorized by this chapter, a business that contains a deck, dock, or structure that is located in a critical area may utilize such deck, dock, or structure for purposes that directly relate to the operation of the business.

 

Renumber sections to conform.

Amend title to conform.

State Expenditure

This bill allows a business with a deck, dock, or other structure located in a critical area to use the structure for purposes directly related to the operation of the business provided a plan for utilization is submitted and approved by the local zoning board that has jurisdiction where the business is located.  Critical area permitting is currently regulated by DHEC's OCRM, which will be under the authority of the future DES beginning July 1, 2024.  DHEC does not anticipate any additional permitting or inspections will be necessary due to the bill.  Therefore, the bill is not expected to have an expenditure impact on DHEC or DES.

A bill

 

TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING SECTION 48-39-148 SO AS TO AUTHORIZE BUSINESSES WITH A DECK, DOCK, OR OTHER STRUCTURE LOCATED IN A CRITICAL AREA TO USE THE STRUCTURE FOR PURPOSES DIRECTLY RELATED TO THE OPERATION OF THE BUSINESS WITH LOCAL ZONING APPROVAL.

 

Be it enacted by the General Assembly of the State of South Carolina:

 

SECTION 1.  Chapter 39, Title 48 of the S.C. Code is amended by adding:

 

    Section 48-39-148. Notwithstanding any statutory or regulatory provision of law to the contrary, including any provision of or authorized by this chapter, a business that contains a deck, dock, or structure that is located in a critical area may utilize such deck, dock, or structure for purposes that directly relate to the operation of the business provided a plan for utilization is submitted and approved by the local zoning board that has jurisdiction where the business is located.

 

SECTION 2.  This act takes effect upon approval by the Governor.
