AN ACT

  

1

Amending the act of June 3, 1937 (P.L.1333, No.320), entitled

2

"An act concerning elections, including general, municipal,

3

special and primary elections, the nomination of candidates,

4

primary and election expenses and election contests; creating

5

and defining membership of county boards of elections;

6

imposing duties upon the Secretary of the Commonwealth,

7

courts, county boards of elections, county commissioners;

8

imposing penalties for violation of the act, and codifying,

9

revising and consolidating the laws relating thereto; and

10

repealing certain acts and parts of acts relating to

11

elections," in penalties, further providing for children in

12

polling places and voting compartments or voting machine

13

booths.

The General Assembly of the Commonwealth of Pennsylvania

15

hereby enacts as follows:

16

Section 1.  Section 1831.1 of the act of June 3, 1937

17

(P.L.1333, No.320), known as the Pennsylvania Election Code,

18

added December 17, 1990 (P.L.681, No.169), is amended to read:

Section 1831.1.  Children in Polling Places and Voting

20

Compartments or Voting Machine Booths.--(a)  Notwithstanding any

21

other provision of this act, an elector may permit his or her

22

minor child or children to accompany him or her into the polling

place and may permit one such minor child to accompany him or

2

her into the voting compartment or voting machine booth.

3

(b)  Notwithstanding any other provision of this act, a local

4

judge of elections may permit a group of supervised children to

5

observe a polling place with the following restrictions:

6

(1)  The group shall be observing the polling place as part

7

of a school curriculum.

8

(2)  The teacher or group leader shall provide advance notice

9

to the local judge of elections for approval of the observation.

10

(3)  The observation shall occur at an off-peak or other time

11

that will ensure as little disruption in voting to the public as

12

possible.

13

(4)  The local judge of election shall limit the size of the

14

observing group and the group's supervisors as needed based on

15

the size of the polling location.

16

Section 2.  This act shall take effect in 60 days.
