| created by the resignation of John Boccieri of | 3 |
| the 33rd Senatorial District. | 4 |
BE IT RESOLVED BY THE SENATE OF THE STATE OF OHIO:
| WHEREAS, Section 11 of Article II, Ohio Constitution, | 5 |
| provides for the filling of a vacancy in the Senate by appointment | 6 |
| by the members of the Senate who are affiliated with the same | 7 |
| political party as the person last elected to the seat which has | 8 |
| become vacant; and | 9 |
| WHEREAS, John Boccieri of the 33rd Senatorial District has | 10 |
| resigned as a member of the Senate effective December 31, 2008, | 11 |
| thus creating a vacancy in the Senate; now therefore be it | 12 |
| RESOLVED, By the members of the Senate who are affiliated | 13 |
| with the Democrat party, that Joe Schiavoni (Democrat), having the | 14 |
| qualifications set forth in the Ohio Constitution and the laws of | 15 |
| Ohio to be a member of the Senate from the 33rd Senatorial | 16 |
| District is hereby appointed, pursuant to Section 11 of Article | 17 |
| II, Ohio Constitution, as a member of the Senate from the 33rd | 18 |
| Senatorial District, to fill the vacancy created by John Boccieri; and be it further | 20 |
| RESOLVED, That a copy of this Resolution be spread upon the | 21 |
| journal of the Senate together with the yeas and nays of the | 22 |
| members of the Senate affiliated with the Democrat party voting on | 23 |
| the Resolution, and that the Clerk of the Senate shall certify the | 24 |
| Resolution and the vote on its adoption to the Secretary of State. | 25 |
