A BILL
To amend section 4501.21 and to enact section 4503.86 1
of the Revised Code to create the "Lincoln 2
Highway" license plate.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.86 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.492, 4503.493, 4503.494, 4503.496, 4503.498, 10
4503.499, 4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 11
4503.522, 4503.523, 4503.524, 4503.525, 4503.526, 4503.531, 12
4503.534, 4503.545, 4503.55, 4503.551, 4503.552, 4503.553, 13
4503.554, 4503.561, 4503.562, 4503.564, 4503.591, 4503.67, 14
4503.68, 4503.69, 4503.701, 4503.71, 4503.711, 4503.712, 4503.713, 15
4503.72, 4503.73, 4503.732, 4503.74, 4503.75, 4503.751, 4503.85, 16
4503.86, 4503.89, 4503.90, 4503.92, and 4503.94 of the Revised 17
Code. 18

       (B) The registrar shall pay the contributions the registrar 19
collects in the fund as follows: 20

        The registrar shall pay the contributions received pursuant 21
to section 4503.491 of the Revised Code to the breast cancer fund 22
of Ohio, which shall use that money only to pay for programs that 23
provide assistance and education to Ohio breast cancer patients 24
and that improve access for such patients to quality health care 25
and clinical trials and shall not use any of the money for 26
abortion information, counseling, services, or other 27
abortion-related activities. 28

       The registrar shall pay the contributions the registrar 29
receives pursuant to section 4503.492 of the Revised Code to the 30
organization cancer support community central Ohio, which shall 31
deposit the money into the Sheryl L. Kraner Fund of that 32
organization. Cancer support community central Ohio shall expend 33
the money it receives pursuant to this division only in the same 34
manner and for the same purposes as that organization expends 35
other money in that fund.36

        The registrar shall pay the contributions received pursuant 37
to section 4503.493 of the Revised Code to the autism society of 38
Ohio, which shall use the contributions for programs and autism 39
awareness efforts throughout the state. 40

       The registrar shall pay the contributions the registrar 41
receives pursuant to section 4503.494 of the Revised Code to the 42
national multiple sclerosis society for distribution in equal 43
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 44
chapters of the national multiple sclerosis society. These 45
chapters shall use the money they receive under this section to 46
assist in paying the expenses they incur in providing services 47
directly to their clients.48

       The registrar shall pay the contributions the registrar 49
receives pursuant to section 4503.496 of the Revised Code to the 50
Ohio sickle cell and health association, which shall use the 51
contributions to help support educational, clinical, and social 52
support services for adults who have sickle cell disease.53

       The registrar shall pay the contributions the registrar 54
receives pursuant to section 4503.498 of the Revised Code to 55
special olympics Ohio, inc., which shall use the contributions for 56
its programs, charitable efforts, and other activities. 57

       The registrar shall pay the contributions the registrar 58
receives pursuant to section 4503.499 of the Revised Code to the 59
children's glioma cancer foundation, which shall use the 60
contributions for its research and other programs. 61

        The registrar shall pay the contributions the registrar 62
receives pursuant to section 4503.50 of the Revised Code to the 63
future farmers of America foundation, which shall deposit the 64
contributions into its general account to be used for educational 65
and scholarship purposes of the future farmers of America 66
foundation. 67

        The registrar shall pay the contributions the registrar 68
receives pursuant to section 4503.501 of the Revised Code to the 69
4-H youth development program of the Ohio state university 70
extension program, which shall use those contributions to pay the 71
expenses it incurs in conducting its educational activities. 72

        The registrar shall pay the contributions received pursuant 73
to section 4503.502 of the Revised Code to the Ohio cattlemen's 74
foundation, which shall use those contributions for scholarships 75
and other educational activities. 76

       The registrar shall pay the contributions received pursuant 77
to section 4503.505 of the Revised Code to the organization Ohio 78
region phi theta kappa, which shall use those contributions for 79
scholarships for students who are members of that organization. 80

        The registrar shall pay each contribution the registrar 81
receives pursuant to section 4503.51 of the Revised Code to the 82
university or college whose name or marking or design appears on 83
collegiate license plates that are issued to a person under that 84
section. A university or college that receives contributions from 85
the fund shall deposit the contributions into its general 86
scholarship fund. 87

        The registrar shall pay the contributions the registrar 88
receives pursuant to section 4503.522 of the Revised Code to the 89
"friends of Perry's victory and international peace memorial, 90
incorporated," a nonprofit corporation organized under the laws of 91
this state, to assist that organization in paying the expenses it 92
incurs in sponsoring or holding charitable, educational, and 93
cultural events at the monument. 94

       The registrar shall pay the contributions the registrar 95
receives pursuant to section 4503.523 of the Revised Code to the 96
fairport lights foundation, which shall use the money to pay for 97
the restoration, maintenance, and preservation of the lighthouses 98
of fairport harbor. 99

       The registrar shall pay the contributions the registrar 100
receives pursuant to section 4503.524 of the Revised Code to the 101
Massillon tiger football booster club, which shall use the 102
contributions only to promote and support the football team of 103
Washington high school of the Massillon city school district.104

       The registrar shall pay the contributions the registrar 105
receives pursuant to section 4503.525 of the Revised Code to the 106
United States power squadron districts seven, eleven, twenty-four, 107
and twenty-nine in equal amounts. Each power squadron district 108
shall use the money it receives under this section to pay for the 109
educational boating programs each district holds or sponsors 110
within this state.111

       The registrar shall pay the contributions the registrar 112
receives pursuant to section 4503.526 of the Revised Code to the 113
Ohio district Kiwanis foundation of the Ohio district of Kiwanis 114
international, which shall use the money it receives under this 115
section to pay the costs of its educational and humanitarian 116
activities.117

       The registrar shall pay the contributions the registrar 118
receives pursuant to section 4503.531 of the Revised Code to the 119
thank you foundation, incorporated, a nonprofit corporation 120
organized under the laws of this state, to assist that 121
organization in paying for the charitable activities and programs 122
it sponsors in support of United States military personnel, 123
veterans, and their families.124

       The registrar shall pay the contributions the registrar 125
receives pursuant to section 4503.534 of the Revised Code to the 126
disabled American veterans department of Ohio, to be used for 127
programs that serve disabled American veterans and their families.128

        The registrar shall pay the contributions the registrar 129
receives pursuant to section 4503.55 of the Revised Code to the 130
pro football hall of fame, which shall deposit the contributions 131
into a special bank account that it establishes and which shall be 132
separate and distinct from any other account the pro football hall 133
of fame maintains, to be used exclusively for the purpose of 134
promoting the pro football hall of fame as a travel destination. 135

        The registrar shall pay the contributions that are paid to 136
the registrar pursuant to section 4503.545 of the Revised Code to 137
the national rifle association foundation, which shall use the 138
money to pay the costs of the educational activities and programs 139
the foundation holds or sponsors in this state. 140

        The registrar shall pay to the Ohio pet fund the 141
contributions the registrar receives pursuant to section 4503.551 142
of the Revised Code and any other money from any other source, 143
including donations, gifts, and grants, that is designated by the 144
source to be paid to the Ohio pet fund. The Ohio pet fund shall 145
use the moneys it receives under this section to support programs 146
for the sterilization of dogs and cats and for educational 147
programs concerning the proper veterinary care of those animals, 148
and for expenses of the Ohio pet fund that are reasonably 149
necessary for it to obtain and maintain its tax-exempt status and 150
to perform its duties. 151

        The registrar shall pay the contributions the registrar 152
receives pursuant to section 4503.552 of the Revised Code to the 153
rock and roll hall of fame and museum, incorporated. 154

        The registrar shall pay the contributions the registrar 155
receives pursuant to section 4503.553 of the Revised Code to the 156
Ohio coalition for animals, incorporated, a nonprofit corporation. 157
Except as provided in division (B) of this section, the coalition 158
shall distribute the money to its members, and the members shall 159
use the money only to pay for educational, charitable, and other 160
programs of each coalition member that provide care for unwanted, 161
abused, and neglected horses. The Ohio coalition for animals may 162
use a portion of the money to pay for reasonable marketing costs 163
incurred in the design and promotion of the license plate and for 164
administrative costs incurred in the disbursement and management 165
of funds received under this section. 166

       The registrar shall pay the contributions the registrar 167
receives pursuant to section 4503.554 of the Revised Code to the 168
Ohio state council of the knights of Columbus, which shall use the 169
contributions to pay for its charitable activities and programs.170

        The registrar shall pay the contributions the registrar 171
receives pursuant to section 4503.561 of the Revised Code to the 172
state of Ohio chapter of ducks unlimited, inc., which shall 173
deposit the contributions into a special bank account that it 174
establishes. The special bank account shall be separate and 175
distinct from any other account the state of Ohio chapter of ducks 176
unlimited, inc., maintains and shall be used exclusively for the 177
purpose of protecting, enhancing, restoring, and managing wetlands 178
and conserving wildlife habitat. The state of Ohio chapter of 179
ducks unlimited, inc., annually shall notify the registrar in 180
writing of the name, address, and account to which such payments 181
are to be made. 182

        The registrar shall pay the contributions the registrar 183
receives pursuant to section 4503.562 of the Revised Code to the 184
Mahoning river consortium, which shall use the money to pay the 185
expenses it incurs in restoring and maintaining the Mahoning river 186
watershed. 187

       The registrar shall pay the contributions the registrar 188
receives pursuant to section 4503.564 of the Revised Code to 189
Antioch college for the use of the Glen Helen ecology institute to 190
pay expenses related to the Glen Helen nature preserve.191

        The registrar shall pay to a sports commission created 192
pursuant to section 4503.591 of the Revised Code each contribution 193
the registrar receives under that section that an applicant pays 194
to obtain license plates that bear the logo of a professional 195
sports team located in the county of that sports commission and 196
that is participating in the license plate program pursuant to 197
division (E) of that section, irrespective of the county of 198
residence of an applicant. 199

        The registrar shall pay to a community charity each 200
contribution the registrar receives under section 4503.591 of the 201
Revised Code that an applicant pays to obtain license plates that 202
bear the logo of a professional sports team that is participating 203
in the license plate program pursuant to division (G) of that 204
section. 205

        The registrar shall pay the contributions the registrar 206
receives pursuant to section 4503.67 of the Revised Code to the 207
Dan Beard council of the boy scouts of America. The council shall 208
distribute all contributions in an equitable manner throughout the 209
state to regional councils of the boy scouts. 210

        The registrar shall pay the contributions the registrar 211
receives pursuant to section 4503.68 of the Revised Code to the 212
great river council of the girl scouts of the United States of 213
America. The council shall distribute all contributions in an 214
equitable manner throughout the state to regional councils of the 215
girl scouts. 216

        The registrar shall pay the contributions the registrar 217
receives pursuant to section 4503.69 of the Revised Code to the 218
Dan Beard council of the boy scouts of America. The council shall 219
distribute all contributions in an equitable manner throughout the 220
state to regional councils of the boy scouts. 221

       The registrar shall pay the contributions the registrar 222
receives pursuant to section 4503.701 of the Revised Code to the 223
Prince Hall grand lodge of free and accepted masons of Ohio, which 224
shall use the contributions for scholarship purposes.225

        The registrar shall pay the contributions the registrar 226
receives pursuant to section 4503.71 of the Revised Code to the 227
fraternal order of police of Ohio, incorporated, which shall 228
deposit the fees into its general account to be used for purposes 229
of the fraternal order of police of Ohio, incorporated. 230

        The registrar shall pay the contributions the registrar 231
receives pursuant to section 4503.711 of the Revised Code to the 232
fraternal order of police of Ohio, incorporated, which shall 233
deposit the contributions into an account that it creates to be 234
used for the purpose of advancing and protecting the law 235
enforcement profession, promoting improved law enforcement 236
methods, and teaching respect for law and order. 237

       The registrar shall pay the contributions received pursuant 238
to section 4503.712 of the Revised Code to Ohio concerns of police 239
survivors, which shall use those contributions to provide whatever 240
assistance may be appropriate to the families of Ohio law 241
enforcement officers who are killed in the line of duty. 242

       The registrar shall pay the contributions received pursuant 243
to section 4503.713 of the Revised Code to the greater Cleveland 244
peace officers memorial society, which shall use those 245
contributions to honor law enforcement officers who have died in 246
the line of duty and support its charitable purposes.247

       The registrar shall pay the contributions the registrar 248
receives pursuant to section 4503.72 of the Revised Code to the 249
organization known on March 31, 2003, as the Ohio CASA/GAL 250
association, a private, nonprofit corporation organized under 251
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 252
shall use these contributions to pay the expenses it incurs in 253
administering a program to secure the proper representation in the 254
courts of this state of abused, neglected, and dependent children, 255
and for the training and supervision of persons participating in 256
that program. 257

        The registrar shall pay the contributions the registrar 258
receives pursuant to section 4503.73 of the Revised Code to Wright 259
B. Flyer, incorporated, which shall deposit the contributions into 260
its general account to be used for purposes of Wright B. Flyer, 261
incorporated. 262

       The registrar shall pay the contributions the registrar 263
receives pursuant to section 4503.732 of the Revised Code to the 264
Siegel & Shuster society, a nonprofit organization dedicated to 265
commemorating and celebrating the creation of Superman in 266
Cleveland, Ohio.267

       The registrar shall pay the contributions the registrar 268
receives pursuant to section 4503.74 of the Revised Code to the 269
Columbus zoological park association, which shall disburse the 270
moneys to Ohio's major metropolitan zoos, as defined in section 271
4503.74 of the Revised Code, in accordance with a written 272
agreement entered into by the major metropolitan zoos. 273

       The registrar shall pay the contributions the registrar 274
receives pursuant to section 4503.75 of the Revised Code to the 275
rotary foundation, located on March 31, 2003, in Evanston, 276
Illinois, to be placed in a fund known as the permanent fund and 277
used to endow educational and humanitarian programs of the rotary 278
foundation. 279

       The registrar shall pay the contributions the registrar 280
receives pursuant to section 4503.751 of the Revised Code to the 281
Ohio association of realtors, which shall deposit the 282
contributions into a property disaster relief fund maintained 283
under the Ohio realtors charitable and education foundation.284

        The registrar shall pay the contributions the registrar 285
receives pursuant to section 4503.85 of the Revised Code to the 286
Ohio sea grant college program to be used for Lake Erie area 287
research projects. 288

       The registrar shall pay the contributions the registrar 289
receives pursuant to section 4503.86 of the Revised Code to the 290
Ohio Lincoln highway historic byway, which shall use those 291
contributions solely to promote and support the historical 292
preservation and advertisement of the Lincoln highway in this 293
state.294

       The registrar shall pay the contributions the registrar 295
receives pursuant to section 4503.89 of the Revised Code to the 296
American red cross of greater Columbus on behalf of the Ohio 297
chapters of the American red cross, which shall use the 298
contributions for disaster readiness, preparedness, and response 299
programs on a statewide basis.300

       The registrar shall pay the contributions the registrar 301
receives pursuant to section 4503.90 of the Revised Code to the 302
nationwide children's hospital foundation.303

       The registrar shall pay the contributions received pursuant 304
to section 4503.92 of the Revised Code to support our troops, 305
incorporated, a national nonprofit corporation, which shall use 306
those contributions in accordance with its articles of 307
incorporation and for the benefit of servicemembers of the armed 308
forces of the United States and their families when they are in 309
financial need. 310

       The registrar shall pay the contributions the registrar 311
receives pursuant to section 4503.94 of the Revised Code to the 312
Michelle's leading star foundation, which shall use the money 313
solely to fund the rental, lease, or purchase of the simulated 314
driving curriculum of the Michelle's leading star foundation by 315
boards of education of city, exempted village, local, and joint 316
vocational school districts.317

       (C) All investment earnings of the license plate contribution 318
fund shall be credited to the fund. Not later than the first day 319
of May of every year, the registrar shall distribute to each 320
entity described in division (B) of this section the investment 321
income the fund earned the previous calendar year. The amount of 322
such a distribution paid to an entity shall be proportionate to 323
the amount of money the entity received from the fund during the 324
previous calendar year.325

       Sec. 4503.86.  (A) The owner or lessee of any passenger car, 326
noncommercial motor vehicle, recreational vehicle, or other 327
vehicle of a class approved by the registrar of motor vehicles may 328
apply to the registrar for the registration of the vehicle and the 329
issuance of "Lincoln highway" license plates. An application made 330
under this section may be combined with a request for a special 331
reserved license plate under section 4503.40 or 4503.42 of the 332
Revised Code. Upon receipt of the completed application and 333
compliance by the applicant with divisions (B) and (C) of this 334
section, the registrar shall issue to the applicant the 335
appropriate vehicle registration and a set of "Lincoln highway" 336
license plates and a validation sticker, or a validation sticker 337
alone when required by section 4503.191 of the Revised Code.338

       In addition to the letters and numbers ordinarily inscribed 339
on the license plates, "Lincoln highway" license plates shall be 340
inscribed with identifying words or markings that are designed by 341
the Ohio Lincoln highway historic byway, and approved by the 342
registrar. "Lincoln highway" license plates shall display county 343
identification stickers that identify the county of registration 344
by name or number.345

       (B) "Lincoln highway" license plates and a validation 346
sticker, or validation sticker alone, shall be issued upon receipt 347
of a contribution as provided in division (C)(1) of this section 348
and upon payment of the regular license tax as prescribed under 349
section 4503.04 of the Revised Code, any applicable motor vehicle 350
license tax levied under Chapter 4504. of the Revised Code, any 351
applicable additional fee prescribed by section 4503.40 or 4503.42 352
of the Revised Code, a bureau of motor vehicles administrative fee 353
of ten dollars, and compliance with all other applicable laws 354
relating to the registration of motor vehicles.355

       (C)(1) For each application for registration and registration 356
renewal notice the registrar receives under this section, the 357
registrar shall collect a contribution of twenty dollars. The 358
registrar shall deposit this contribution into the state treasury 359
to the credit of the license plate contribution fund created in 360
section 4501.21 of the Revised Code.361

       (2) The registrar shall deposit the bureau administrative fee 362
of ten dollars, the purpose of which is to compensate the bureau 363
for additional services required in the issuing of "Lincoln 364
highway" license plates, into the state treasury to the credit of 365
the state bureau of motor vehicles fund created in section 4501.25 366
of the Revised Code.367

       Section 2.  That existing section 4501.21 of the Revised Code 368
is hereby repealed.369

       Section 3.  Section 4501.21 of the Revised Code is presented 370
in this act as a composite of the section as amended by Am. Sub. 371
H.B. 23, Sub. H.B. 206, and Am. S.B. 186, all of the 130th General 372
Assembly. The General Assembly, applying the principle stated in 373
division (B) of section 1.52 of the Revised Code that amendments 374
are to be harmonized if reasonably capable of simultaneous 375
operation, finds that the composite is the resulting version of 376
the section in effect prior to the effective date of the section 377
as presented in this act.378
