Bill Title: To make clear that any person may perform automated external defibrillation, to extend qualified immunity from civil liability to premises owners and other persons involved with automated external defibrillator placement and use, to allow proceedings for a mentally ill person subject to court order to be in a probate court in any county, rather than in the county where the mentally ill person subject to court order resides, and to modify the form of the affidavit used to initiate proceedings for court-ordered treatment of a mentally ill person.

A BILL
To amend section 3701.85 of the Revised Code to make 1
clear that any person may perform automated 2
external defibrillation.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3701.85 of the Revised Code be 4
amended to read as follows:5

       Sec. 3701.85.  (A) As used in this section:6

       (1) "Automated external defibrillation" has the same meaning 7
as in section 2305.235 of the Revised Code.8

       (2) "Emergency medical services organization" has the same 9
meaning as in section 4765.01 of the Revised Code.10

       (3) "Emergency medical service provider" means a person who 11
is an "emergency medical technician-basic," "emergency medical 12
technician-intermediate," "emergency medical 13
technician-paramedic," or "first responder" as defined in section 14
4765.01 of the Revised Code.15

       (4) "Physician" has the same meaning as in section 4765.01 of 16
the Revised Code.17

       (5) "Registered nurse" and "licensed practical nurse" have 18
the same meanings as in section 4723.01 of the Revised Code.19

       (B) A person who possesses an automated external 20
defibrillator shall do allboth of the following:21

       (1) RequireEncourage expected users to complete successfully 22
a course in automated external defibrillation and cardiopulmonary 23
resuscitation that is offered or approved by the American heart 24
association or anothera nationally recognized organization;25

       (2) Maintain and test the defibrillator according to the 26
manufacturer's guidelines;27

       (3) Consult with a physician regarding compliance with the 28
requirements of divisions (B)(1) and (2) of this section.29

       (C) A person who possesses an automated external 30
defibrillator may notify an emergency medical services 31
organization of the location of the defibrillator.32

       (D) AAny person who has obtained appropriate training on how 33
to perform automated external defibrillation and has successfully 34
completed a course in cardiopulmonary resuscitation may perform 35
automated external defibrillation, regardless of whether the 36
person is a physician, registered nurse, licensed practical nurse, 37
or emergency medical service provider. WhenTraining in automated 38
external defibrillation and cardiopulmonary resuscitation is 39
recommended but not required.40

       When automated external defibrillation is not performed as 41
part of an emergency medical services system or at a hospital as 42
defined in section 3727.01 of the Revised Code, an emergency 43
medical services system shall be activated as soon as possible.44

       Section 2. That existing section 3701.85 of the Revised Code 45
is hereby repealed.46
