STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to tuition payments for chartered public school pupils.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Adequate Education Grants; Tuition Payments to Chartered Public Schools. Amend RSA 198:42, IV to read as follows:

IV. For the fiscal year-beginning July 1, [2011] 2013, and every fiscal year thereafter, the [department of education may expend funds up to 110 percent of budgeted amounts as] amount necessary to fund chartered public school tuition payments under RSA 194-B:11, I[. Said amounts are] is hereby appropriated to the department from the education trust fund established under RSA 198:39. The education trust fund shall be used to satisfy the state's obligation under this paragraph. The payment shall be issued regardless of the balance of funds available in the education trust fund. [In the event that chartered public school tuition payments exceed budgeted amounts by over 10 percent, the department of education may expend funds in excess of said amounts, with the approval of the fiscal committee of the general court and governor and council. Said funds shall be paid from the education trust fund established under RSA 198:39 upon the warrant of the governor out of any money in the fund not otherwise appropriated.]

2 Effective Date. This act shall take effect July 1, 2013.

HB 299-FN - FISCAL NOTE

AN ACT relative to tuition payments for chartered public school pupils.

FISCAL IMPACT:

The Department of Education states this bill, as introduced, may increase state expenditures by an indeterminable amount in FY 2014 and each year thereafter. There will be no impact on state revenues, or county and local revenues or expenditures.

METHODOLOGY:

The Department of Education states this bill amends RSA 198:43, IV to appropriate the amount necessary to fund charter school tuition payments under RSA 198-B:11, I. Under current law, if necessary expenditures exceed appropriation, the Department is authorized to expend funds up to 110% of appropriation and seek joint fiscal committee approval to expend beyond 110% of appropriated funds. This bill would eliminate the both of these provisions and allow the Department to expend funds necessary regardless of appropriated amount. This bill may increase state expenditures only to the extent under current law expenditures in excess of 110% of appropriation must be approved by the joint fiscal committee, which may or may not be approved.
