AN ACT establishing a committee to study the establishment of a fund to reimburse costs associated with firefighters who have cancer.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT establishing a committee to study the establishment of a fund to reimburse costs associated with firefighters who have cancer.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Committee Established. There is established a committee to study the establishment of a fund to reimburse costs associated with firefighters who have cancer.

2 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Three members of the house of representatives, one of whom shall be from the minority party, appointed by the speaker of the house of representatives as follows:

(1) One member from the ways and means committee.

(2) One member from the commerce and consumer affairs committee.

(3) One member from the labor, industrial and rehabilitative services committee.

(b) Three members of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3 Duties. The committee shall review the impact of the 1990 superior and supreme court cases relative to the constitutionality of enforcing RSA 281-A:17, II. The committee’s study may include, but not be limited to, the cost effect to workers’ compensation claims relative to firefighter occupational-related cancer disease in New Hampshire and potential funding methods to address the concerns raised by the 1990 court cases.

4 Chairperson; Quorum. The first-named house member shall be the chairperson of the committee and shall call the first meeting of the committee. The first meeting of the committee shall be held within 30 days of the effective date of this section. Four members of the committee shall constitute a quorum.

5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2014.

6 Effective Date. This act shall take effect upon its passage.

HB 1489-FN-A-LOCAL - FISCAL NOTE

AN ACT establishing a fund to reimburse costs associated with firefighters who have heart, lung, and cancer disease and continually appropriating a special fund.

FISCAL IMPACT:

The Departments of Labor and Justice state this bill, as introduced, will have an indeterminable fiscal impact on state, county and local revenue and expenditures in FY 2015 and each year thereafter.

METHODOLOGY:

The Department of Labor states this bill establishes a fund to reimburse costs associated with firefighters who have heart, lung and cancer disease. The Department states it cannot determine the impact of this bill because the costs to be reimbursed are not defined, and the bill does not specify what the assessments that will go into the fund should be based upon, such as claims paid, premium paid or some other factor.

The Department of Justice states this bill would require the attorney general to appoint an employee of the Department to represent the fund in all proceedings brought to enforce claims against the fund. The Department has no information on how many enforcement claims against the fund would be generated or if any of these cases would be appealed to determine the fiscal impact of this bill.
