1.1A bill for an act
1.2relating to health; requiring accreditation of advanced diagnostic imaging
1.3services operating in the state;proposing coding for new law in Minnesota
1.4Statutes, chapter 144.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [144.1225] ADVANCED DIAGNOSTIC IMAGING SERVICES.
1.7    Subdivision 1. Definition. For purposes of this section, "advanced diagnostic
1.8imaging services" means services entailing the use of diagnostic magnetic resonance
1.9imaging (MRI) equipment, except that it does not include MRI equipment owned or
1.10operated by a hospital licensed under sections 144.50 to 144.56 or any facility affiliated
1.11with or owned by such hospital.
1.12    Subd. 2. Accreditation required. (a) Except as otherwise provided in paragraph
1.13(b), advanced diagnostic imaging services eligible for reimbursement from any source
1.14including, but not limited to, the individual receiving such services and any individual
1.15or group insurance contract, plan, or policy delivered in this state including, but not
1.16limited to, private health insurance plans, workers' compensation insurance, motor vehicle
1.17insurance, the State Employee Group Insurance Program (SEGIP), and other state health
1.18care programs shall be reimbursed only if the facility at which the service has been
1.19conducted and processed is accredited by one of the following entities:
1.20(1) American College of Radiology (ACR);
1.21(2) Intersocietal Accreditation Commission (IAC); or
1.22(3) the joint commission.
1.23(b) Any facility that performs advanced diagnostic imaging services and is eligible
1.24to receive reimbursement for such services from any source in paragraph (a) must obtain
2.1accreditation by August 1, 2013. Thereafter, all facilities that provide advanced diagnostic
2.2imaging services in the state must obtain accreditation prior to commencing operations
2.3and must, at all times, maintain accreditation with an accrediting organization as provided
2.4in paragraph (a).
2.5    Subd. 3. Reporting. (a) Advanced diagnostic imaging facilities and providers
2.6of advanced diagnostic imaging services must annually report to the commissioner
2.7demonstration of accreditation as required under this section.
2.8(b) The commissioner may promulgate any rules necessary to administer the
2.9reporting required under paragraph (a).
