A BILL FOR AN ACT

 

 

RELATING TO THE TRANSITIONS CLINIC NETWORK PILOT PROGRAM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State's high incarceration rates cost the State and its taxpayers millions of dollars every year.  In fiscal year 2019, Hawaii had an average combined monthly jail and prison population of 5,217 inmates in both state and private, mainland facilities.  Additionally, a large amount of the State's incarcerated population need health care services during and after incarceration, including mental health services.

     The legislature further finds that a transitions clinic network program would provide patient-centered primary care facilities for chronically-ill individuals released from incarceration.  The program, designed in partnership with formerly incarcerated individuals, would be based within safety-net community health centers in neighborhoods most impacted by incarceration.  Each clinic would collaborate with correctional partners to provide continuity of care, easy access to comprehensive primary care, culturally competent patient-centered medical services, and close partnerships with local reentry organizations to address social determinants of health.  The program would also address the complex barriers that patients and health systems face when trying to improve the health of, and enhance the health care services provided to, chronically-ill individuals who return from incarceration.

     The purpose of this Act is to require the department of human services to procure the services of a master contractor and require the master contractor to implement and operate a transitions clinic network pilot program.

     SECTION 2.  (a)  The department of human services shall:

     (1)  Procure the services of a master contractor;

     (2)  Oversee the funds expended by the master contractor; and

     (3)  Develop and require the master contractor to implement policies and procedures for a fair and equitable procurement process for subcontractors made between the master contractor and subcontracted provider agencies that are consistent with the goals of public accountability and public procurement practices.

     (b)  The master contractor shall:

     (1)  Implement and operate the transitions clinic network pilot program, which shall be an evidence-based model of care that provides to previously-incarcerated individuals with chronic health conditions continuity of care services, access to comprehensive primary care, and patient-centered primary health care facilities after release from incarceration;

     (2)  Procure and oversee subcontracts for the transitions clinic network pilot program, in accordance with chapter 103D or 103F, Hawaii Revised Statutes;

     (3)  Create partnerships with local reentry organizations;

     (4)  Allow community health workers to connect participants to health and social services and assist participants with navigating through post-release life;

     (5)  Create health care system enhancements for patient-centered services, including but not limited to early access to primary care, behavioral health integration, and medication-assisted treatment for substance use disorders;

     (6)  At a minimum, provide quarterly reports to the house of representatives and senate committees on housing and human services;

     (7)  Develop reporting procedures and timelines for providing performance information to respective state agencies;

     (8)  Use the moneys appropriated in section 3 of this Act to implement and operate the transitions clinic network pilot program, including implementing the program in one primary care health clinic, providing training and salaries and benefits to two community health workers, and procuring staff computers and other supplies; provided that the master contractor may retain from the amounts paid under the master contract between the master contractor and subcontractors an administrative fee in an amount not to exceed fifteen per cent of the total contract price; and

     (9)  Be accountable for funds expended.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2020-2021 for the department of human services to procure the services of a master contractor and for the master contractor to implement and operate the transitions clinic network pilot program.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act; provided that the department shall provide to the master contractor at the beginning of the transitions clinic network pilot program the total sum of the moneys expended.

     SECTION 4.  This Act shall take effect on July 1, 2050.
