SENATE JOINT RESOLUTION NO. 8

HOUSE AMENDMENT NO. 1


DIRECTING THE EXECUTIVE TO EXAMINE OVERLAPPING OR UNNECESSARY REGULATIONS ACROSS CABINET DEPARTMENTS AND RECOMMEND TO THE GENERAL ASSEMBLY LEGISLATION NECESSARY TO ADDRESS THESE REGULATIONS.



WHEREAS, the "Blue Collar" Task Force was composed of four legislators, five cabinet secretaries, eight representatives of business and labor groups from throughout the state, and three additional public appointed members; and

WHEREAS, the Task Force meet as a group and additionally held public hearings throughout Delaware to listen to the concerns of citizens and local businesses, both large and small; and

WHEREAS, the Task Force received extensive testimony that many regulations and requirements among and between Cabinet agencies necessary to conduct and grow business are duplicative, inconsistent, and sometimes unnecessary, and further, that these regulations create both a burden and barrier, particularly for small businesses; and

WHEREAS, the Task Force concluded that these barriers affected businesses' ability to expand and create new jobs; and

WHEREAS, Governor Markell has already successfully directed individual Cabinet agencies to examine their internal regulations and eliminate or consolidate those resolutions they deemed unnecessary. As a result of those efforts, the Governor and Cabinet officials have taken action through Executive Orders to address these regulations; and

WHEREAS, the Task Force as a result of its deliberation believes that such a process conducted by the Cabinet as a whole would be helpful to eliminate cross-agency contradictory regulations that add unnecessary red tape and burdens that hinder, particularly, small business expansion; and

WHEREAS, the report of the "Blue Collar" Task Force recommends the implementation of a cross-agency review of regulatory and licensing practices;

NOW, THEREFORE:

BE IT RESOLVED by the Senate and the House of Representatives of the 147th General Assembly of the State of Delaware, with the approval of the Governor, that the Cabinet, working as a whole, shall immediately conduct a cross-agency review to make the regulatory and licensing process more efficient for businesses and report to the General Assembly by October 1, 2014 regarding any legislative changes needed to implement the recommendations of the Cabinet and the Governor after this review.
