AN ACT PROHIBITING THE STORAGE OR DISPOSAL OF FRACKING WASTE IN CONNECTICUT.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective from passage) No person shall store or dispose of any material described in 40 CFR Part 261.4(b)(5). The Commissioner of Energy and Environmental Protection shall enforce the provisions of this section and shall adopt regulations, in accordance with chapter 54 of the general statutes, to establish a schedule of penalties for the violation of this section.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To prohibit the storage or disposal in this state of materials produced as a by-product of fracking activities.
