An Act

 

amending title 36, chapter 4, article 2, Arizona Revised Statutes, by adding section 36-425.10; relating to health care institutions.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 36, chapter 4, article 2, Arizona Revised Statutes, is amended by adding section 36-425.10, to read:

START_STATUTE36-425.10. Hospitals; drug screening; fentanyl; exception

A. If a hospital conducts a urine drug screening on a patient to assist in diagnosing the patient's condition, the hospital shall include testing for fentanyl as part of the patient's drug screening. This fentanyl testing is solely for the PURPOSES of medical diagnosis and may not be used for law enforcement purposes.

B. Subsection A of this section does not apply to a hospital that does not have the capability or equipment to conduct a rapid urine drug test for the presence of fentanyl.END_STATUTE
