A Concurrent Resolution

 

proposing an amendment to the Constitution of Arizona; amending article XXII, Constitution of Arizona, by adding section 23; relating to the death penalty.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1. Article XXII, Constitution of Arizona, is proposed to be amended by adding section 23 as follows if approved by the voters and on proclamation of the Governor:

23. Death penalty writ of execution

section 23. a. The attorney general shall request a writ of execution within thirty days after A person who has been convicted and sentenced to death has exhausted the first petition for postconviction relief or the time to file such a petition has expired and the person has exhausted all appeals at the state and federal court levels.

b. if the attorney general fails to request a writ of execution as prescribed by subsection A of this section, the county attorney for the county in which the person was convicted shall request the writ of execution.

c. the governor and the state department of corrections shall complete the execution within thirty days after receiving the writ of execution.

D. The governor and the attorney general shall be liable to impeachment for failing to comply with this section.

2. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
