HOUSE BILL 2377

 

 

 

 

An Act

 

providing for costs and revenue study of the price of managing federal lands.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Federal lands; cost and revenue study; delayed repeal

A. The auditor general and the joint legislative budget committee shall conduct and complete a cost and revenue study of the annual cost to manage all federal land in this state that is not under the control of the United States department of defense, United States bureau of Indian affairs or the United States bureau of reclamation and all current revenues generated by federal land not under control of the United States department of defense, United States bureau of Indian affairs or the United States bureau of reclamation. The auditor general and the joint legislative budget committee shall assume for the purpose of the study that control and management of all federal land, except land under the control of the United States department of defense, United States bureau of Indian affairs or the United States bureau of reclamation, and all current revenues generated by federal land not under control of the United States department of defense, United States bureau of Indian affairs or the United States bureau of reclamation are given to this state at no cost to this state.

B. For the purposes of this section, on request by the auditor general or the joint legislative budget committee, the following agencies shall cooperate with and provide all necessary information to the auditor general and the joint legislative budget committee:

1. The Arizona game and fish department.

2. The Arizona state parks board.

3. The department of administration.

4. The department of law.

5. The department of environmental quality.

6. The department of water resources.

7. The state forester.

8. The state land department.

9. Any other agency or political subdivision the auditor general and the joint legislative budget committee deem to have relevant information regarding the cost and revenue study.

C. The auditor general and the joint legislative budget committee shall submit the cost and revenue study to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this cost and revenue study to the secretary of state within one year after the effective date of this act.

D. For the purposes of this section, the auditor general and the joint legislative budget committee may:

1. Coordinate with any federal agency, department or bureau that controls or manages federal land that is subject to the cost and revenue study pursuant to subsection A of this act.

2. Coordinate with any federal agency, department or bureau that controls, collects or receives revenue from federal land that is subject to the cost and revenue study pursuant to subsection A of this act.

3. Coordinate with any state agency or political subdivision of this state that would likely inherit management or revenue collection duties of lands that are subject to the cost and revenue study pursuant to subsection A of this act.

4. Use any relevant cost or revenue information included in a report or budgetary projection prepared by a federal agency, department or bureau that is relevant to the evaluation of federal land that is subject to the cost and revenue study pursuant to subsection A of this act.

E. This section is repealed from and after December 31, 2025.
