relating to a report regarding certain residential and | ||
nonresidential services provided to individuals with an | ||
intellectual or developmental disability. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. In this Act, "commission" means the Health and | ||
Human Services Commission. | ||
SECTION 2. (a) Not later than December 1, 2024, the | ||
commission shall prepare and submit to the legislature a written | ||
report regarding state and federally-funded residential and | ||
nonresidential services provided: | ||
(1) under the home and community-based services (HCS) | ||
waiver program; | ||
(2) under the Texas home living (TxHmL) waiver | ||
program; and | ||
(3) by intermediate care facilities licensed under | ||
Chapter 252, Health and Safety Code. | ||
(b) The report required under this section must: | ||
(1) analyze the average monthly cost to the state per | ||
person disaggregated by level of need for services provided to | ||
individuals: | ||
(A) residing in state-operated and privately | ||
operated intermediate care facilities licensed under Chapter 252, | ||
Health and Safety Code, disaggregated by facility size for | ||
privately operated facilities; | ||
(B) under the home and community-based services | ||
(HCS) waiver program; and | ||
(C) under the Texas home living (TxHmL) waiver | ||
program; | ||
(2) compare the severity of need for individuals | ||
across settings; and | ||
(3) include, based on data from the previous biennium: | ||
(A) the total number of individuals, | ||
disaggregated by level of need, who transitioned from | ||
state-operated intermediate care facilities licensed under Chapter | ||
252, Health and Safety Code, to receiving services under the home | ||
and community-based services (HCS) waiver program; and | ||
(B) the average monthly cost of services under | ||
the home and community-based services (HCS) waiver program for | ||
individuals described by Paragraph (A). | ||
SECTION 3. This Act expires September 1, 2025. | ||
SECTION 4. This Act takes effect September 1, 2023. |
