A BILL TO BE ENTITLED
 
AN ACT
  relating to translation of a student's individualized education
  program into Spanish or another language other than English.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 29.005(d), Education Code, is amended to
  read as follows:
         (d)  If English is not the native language of the child's
  parent [is unable to speak English], the district shall:
               (1)  provide the parent with a written or audiotaped
  copy of the child's individualized education program translated
  into Spanish if Spanish is the parent's native language; or
               (2)  if the parent's native language is a language other
  than Spanish, make a good faith effort to provide the parent with a
  written or audiotaped copy of the child's individualized education
  program translated into the parent's native language.
         SECTION 2.  This Act applies beginning with the 2023-2024
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
