A BILL TO BE ENTITLED
 
AN ACT
  relating to notice of facial recognition technology used by
  business entities in publicly accessible spaces.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subtitle A, Title 11, Business & Commerce Code,
  is amended by adding Chapter 503A to read as follows:
  CHAPTER 503A. FACIAL RECOGNITION TECHNOLOGY
         Sec. 503A.001.  NOTICE OF FACIAL RECOGNITION TECHNOLOGY USE.
  A business entity that uses facial recognition technology for the
  purpose of identifying a customer or guest in a space located in
  this state that is generally accessible to the public must post a
  clear and conspicuous notice disclosing the business's use of the
  technology in the space. The notice must be posted in a location
  that is clearly viewed by a customer or guest entering the space
  where the technology is used.
         SECTION 2.  This Act takes effect September 1, 2023.
