A BILL TO BE ENTITLED
 
AN ACT
  relating to the means by which schools are compared in the Public
  School Accountability System.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 39.053, Education Code, is amended by
  adding Subsection (c-4) to read as follows:
         (c-4)  For purposes of Subsection (c)(2)(B), the
  commissioner may not compare the relative performance of a campus
  in a district in which student enrollment is based only on a
  student's residence and the relative performance of a campus in a
  district in which a student's parent or person standing in parental
  relation to the student is allowed to enroll the student at a campus
  other than the campus in which the student would attend based on the
  student's residence. 
         SECTION 2.  This Act applies beginning with the 2021-2022
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
