A BILL TO BE ENTITLED
 
AN ACT
  relating to the declaration of a state of disaster and certain state
  operations in a disaster.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 418.014(a), Government Code, is amended
  to read as follows:
         (a)  The governor by executive order or proclamation shall
  [may] declare a state of disaster if the governor finds a disaster
  has occurred or that the occurrence or threat of disaster is
  imminent.
         SECTION 2.  Subchapter C, Chapter 418, Government Code, is
  amended by adding Section 418.0431 to read as follows:
         Sec. 418.0431.  LIST OF NEEDS IN STATE OF DISASTER. The
  division shall create a single intake point for persons affected by
  a disaster to submit requests for resources and assistance. During
  a state of disaster, the division shall compile and distribute a
  list of needs for:
               (1)  persons affected by the disaster; and
               (2)  persons participating in relief efforts.
         SECTION 3.  Section 418.108(a), Government Code, is amended
  to read as follows:
         (a)  Except as provided by Subsection (e), the presiding
  officer of the governing body of a political subdivision shall
  [may] declare a local state of disaster if the presiding officer
  finds a disaster has occurred or that the occurrence or threat of
  disaster is imminent.
         SECTION 4.  This Act takes effect September 1, 2015.
