| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 38, Penal Code, is amended by adding | ||
| Section 38.115 to read as follows: | ||
| Sec. 38.115. TAMPERING WITH CORRECTIONAL FACILITY TABLET | ||
| DEVICE. (a) In this section, "correctional facility" means: | ||
| (1) any place described by Section 1.07(a)(14)(A), | ||
| (B), or (C); or | ||
| (2) a secure correctional facility or secure detention | ||
| facility, as defined by Section 51.02, Family Code. | ||
| (b) A person commits an offense if the person, while | ||
| confined in a correctional facility, alters, modifies, or breaches | ||
| the security, programming, or operating system of a tablet device | ||
| provided to the person by the operator of the correctional | ||
| facility. | ||
| (c) An offense under this section is a felony of the third | ||
| degree. | ||
| SECTION 2. This Act takes effect September 1, 2023. | ||
