| relating to Medicaid coverage and reimbursement for the provision | ||
| of certain digital therapeutics. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 32.024, Human Resources Code, is amended | ||
| by adding Subsection (hh) to read as follows: | ||
| (hh) The commission shall provide medical assistance | ||
| reimbursement to a provider who participates in the vendor drug | ||
| program or is enrolled as a network pharmacy provider in the | ||
| provider network of a managed care organization that contracts with | ||
| the commission under Chapter 533, Government Code, for a | ||
| prescription digital therapeutic, as defined by commission rule, | ||
| that is approved for use by the United States Food and Drug | ||
| Administration. For purposes of this subsection, a digital | ||
| therapeutic is not considered durable medical equipment. | ||
| SECTION 2. If before implementing any provision of this Act | ||
| a state agency determines that a waiver or authorization from a | ||
| federal agency is necessary for implementation of that provision, | ||
| the agency affected by the provision shall request the waiver or | ||
| authorization and may delay implementing that provision until the | ||
| waiver or authorization is granted. | ||
| SECTION 3. This Act takes effect September 1, 2023. | ||
