A BILL TO BE ENTITLED
 
AN ACT
  relating to the confidentiality of certain information in a peace
  officer's or firefighter's personnel file.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 552.102, Government Code, is amended by
  adding Subsection (c) to read as follows:
         (c)  The following information in a peace officer's or
  firefighter's personnel file is confidential and excepted from the
  requirements of Section 552.021:
               (1)  an application for employment;
               (2)  information related to the process of hiring the
  peace officer or firefighter; and
               (3)  a letter, memorandum, or other document relating
  to alleged misconduct by the peace officer or firefighter if the
  employing department:
                     (A)  determines that there is insufficient
  evidence to sustain the charge of misconduct; or
                     (B)  did not take disciplinary action against the
  peace officer or firefighter for the alleged misconduct.
         SECTION 2.  The change in law made by this Act applies to
  information produced or maintained before, on, or after the
  effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2023.
