| relating to the operation of a sport shooting range near a school, | ||
| open-enrollment charter school, or school athletic facility. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subtitle A, Title 9, Health and Safety Code, is | ||
| amended by adding Chapter 769 to read as follows: | ||
| CHAPTER 769. EDUCATIONAL FACILITIES | ||
| Sec. 769.001. OPERATION OF SPORT SHOOTING RANGE NEAR | ||
| EDUCATIONAL FACILITIES PROHIBITED. (a) In this section: | ||
| (1) "Open-enrollment charter school" means a school | ||
| that has been granted a charter under Subchapter D, Chapter 12, | ||
| Education Code. | ||
| (2) "School" means a private or public elementary or | ||
| secondary school. | ||
| (3) "Sport shooting range" has the meaning assigned by | ||
| Section 250.001, Local Government Code. | ||
| (b) A person may not operate a sport shooting range within | ||
| 300 feet from the property line of: | ||
| (1) a school or open-enrollment charter school; or | ||
| (2) a stadium or other athletic facility of the school | ||
| or open-enrollment charter school. | ||
| (c) To the extent that this section conflicts with other | ||
| law, including Chapter 229 or Chapter 236, Local Government Code, | ||
| this section prevails. | ||
| SECTION 2. Section 769.001, Health and Safety Code, as | ||
| added by this Act, applies only to a sport shooting range that | ||
| begins operation on or after the effective date of this Act. | ||
| SECTION 3. This Act takes effect September 1, 2023. | ||
