| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 392, Local Government | ||
| Code, is amended by adding Section 392.0566 to read as follows: | ||
| Sec. 392.0566. PROCUREMENT PROCEDURES FOR CERTAIN | ||
| MUNICIPAL HOUSING AUTHORITIES. Notwithstanding any other law, a | ||
| municipal housing authority described by Section 392.0162 is | ||
| required to comply with competitive procurement procedures | ||
| applicable to municipal housing authorities only when making a | ||
| purchase requiring the expenditure of an amount that is more than | ||
| the simplified acquisition threshold as defined by the Federal | ||
| Acquisition Regulation (48 C.F.R. Section 2.101) or a successor | ||
| regulation. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to a purchase made on or after the effective date of this Act. A | ||
| purchase made before the effective date of this Act is governed by | ||
| the law as it existed immediately before the effective date of this | ||
| Act, and that law is continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2023. | ||
