relating to awarding attorney's fees to an insured who prevails in | ||
an action against an insurer for uninsured or underinsured motorist | ||
coverage. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 1952, Insurance Code, is | ||
amended by adding Section 1952.111 to read as follows: | ||
Sec. 1952.111. ATTORNEY'S FEES. An insured may recover | ||
reasonable attorney's fees in an action against an insurer in | ||
relation to the coverage provided under this subchapter, including | ||
an action to enforce that coverage, if the insured is the prevailing | ||
party. | ||
SECTION 2. This Act applies only to an action for an | ||
insurance policy delivered, issued for delivery, or renewed on or | ||
after January 1, 2014. An action for a policy delivered, issued for | ||
delivery, or renewed before January 1, 2014, is governed by the law | ||
as it existed immediately before the effective date of this Act, and | ||
that law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2013. |
