A BILL TO BE ENTITLED
 
AN ACT
  relating to awarding attorney's fees to an insured who prevails in
  an action against an insurer for uninsured or underinsured motorist
  coverage.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 1952, Insurance Code, is
  amended by adding Section 1952.111 to read as follows:
         Sec. 1952.111.  ATTORNEY'S FEES. An insured may recover
  reasonable attorney's fees in an action against an insurer in
  relation to the coverage provided under this subchapter, including
  an action to enforce that coverage, if the insured is the prevailing
  party.
         SECTION 2.  This Act applies only to an action for an
  insurance policy delivered, issued for delivery, or renewed on or
  after January 1, 2014. An action for a policy delivered, issued for
  delivery, or renewed before January 1, 2014, is governed by the law
  as it existed immediately before the effective date of this Act, and
  that law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2013.
