A BILL TO BE ENTITLED
 
AN ACT
  relating to commissioners court quorum requirements and voting
  requirements applicable to the levying of a county tax.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Sections 81.006(a) and (c), Local Government
  Code, are amended to read as follows:
         (a)  Three members of the commissioners court constitute a
  quorum for conducting county business [except the levying of a
  county tax].
         (c)  A county may not levy a tax unless at least four [three]
  members of the court vote in favor of the levy.
         SECTION 2.  Section 81.006(b), Local Government Code, is
  repealed.
         SECTION 3.  The changes in law made by this Act apply only to
  a vote by a commissioners court on the question of levying a tax
  taken on or after the effective date of this Act. A vote by a
  commissioners court on the question of levying a tax taken before
  the effective date of this Act is governed by the law in effect when
  the vote was taken, and the former law is continued in effect for
  that purpose.
         SECTION 4.  This Act takes effect September 1, 2023.
