AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, in limitation of time

3

relating to criminal proceedings, further providing for no

4

limitation applicable and for other offenses.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Sections 5551 and 5552(b)(1) of Title 42 of the

8

Pennsylvania Consolidated Statutes are amended to read:

9

§ 5551.  No limitation applicable.

10

A prosecution for the following offenses may be commenced at

11

any time:

12

(1)  Murder.

13

(2)  Voluntary manslaughter.

14

(3)  Conspiracy to commit murder or solicitation to

15

commit murder if a murder results from the conspiracy or

16

solicitation.

(4)  Any felony alleged to have been perpetrated in

2

connection with a murder of the first or second degree, as

3

set forth in 18 Pa.C.S. § 2502(a) or (b) and (d) (relating to

4

murder).

(5)  A violation of 75 Pa.C.S. § 3742 (relating to

6

accidents involving death or personal injury) or 3732

7

(relating to homicide by vehicle) if the accused was the

8

driver of a vehicle involved in an accident resulting in the

9

death of any person.

(6)  A violation of 18 Pa.C.S. § 2702(a)(1), (2), (4) or

11

(7) (relating to aggravated assault) if the accused knew the

12

victim was a law enforcement officer and the law enforcement

13

officer was acting within the scope of the officer's duties.

14

(7)  A violation of 18 Pa.C.S. § 3212 (relating to

15

infanticide).

§ 5552.  Other offenses.

(b)  Major offenses.--A prosecution for any of the following

19

offenses must be commenced within five years after it is

20

committed:

21

(1)  Under the following provisions of Title 18 (relating

22

to crimes and offenses):

23

Section 901 (relating to criminal attempt) involving

24

attempt to commit murder where no murder occurs.

25

Section 902 (relating to criminal solicitation)

26

involving solicitation to commit murder where no murder

27

occurs.

Section 903 (relating to criminal conspiracy)

29

involving conspiracy to commit murder where no murder

occurs.

Section 911 (relating to corrupt organizations).

Section 2702 (relating to aggravated assault).

3

Section 2706 (relating to terroristic threats).

4

Section 2713 (relating to neglect of care-dependent

5

person).

Section 2901 (relating to kidnapping).

Section 3211 (relating to abortion on unborn child of

8

24 or more weeks gestational age).

9

Section 3301 (relating to arson and related

10

offenses).

11

Section 3502 (relating to burglary).

12

Section 3701 (relating to robbery).

13

Section 3921 (relating to theft by unlawful taking or

14

disposition) through section 3933 (relating to unlawful

15

use of computer).

Section 4101 (relating to forgery).

Section 4107 (relating to deceptive or fraudulent

18

business practices).

Section 4108 (relating to commercial bribery and

20

breach of duty to act disinterestedly).

21

Section 4109 (relating to rigging publicly exhibited

22

contest).

Section 4117 (relating to insurance fraud).

Section 4701 (relating to bribery in official and

25

political matters) through section 4703 (relating to

26

retaliation for past official action).

Section 4902 (relating to perjury) through section

4912 (relating to impersonating a public servant).
