AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," providing for school police and

6

security officer training.

7

The General Assembly finds and declares as follows:

8

(1)  The General Assembly finds that there are school

9

security officers and security guards employed by school

10

districts across this Commonwealth, who are entrusted with

11

securing our school buildings, property and the safety of our

12

students, staff, administration and all related support staff

13

members employed in the educational setting. These security

14

officers and guards are to ensure that the youth of this

15

Commonwealth have a safe learning environment.

16

(2)  The purpose of this act is to provide for the

17

education, training and certification of such school security

18

guards as a basis of their employment and to prescribe a

course of instruction to obtain such certification.

The General Assembly of the Commonwealth of Pennsylvania

3

hereby enacts as follows:

4

Section 1.  The act of March 10, 1949 (P.L.30, No.14), known

5

as the Public School Code of 1949, is amended by adding a

6

section to read:

7

Section 778.1.  Training Requirements for School Security

8

Officers.--(a)  Education and training requirements are as

9

follows:

10

(1)  A security officer hired by a school district on or

11

after the effective date of this section must have completed a

12

mandated course of training within one year of being hired.

13

(2)  A security officer hired prior to the effective date

14

shall have a fair time frame determined by the board to either

15

give cause, to the board's satisfaction, of why the training

16

should be waived or to take the mandated training course.

17

(3)  An approved training course must include the following

18

topics:

19

(i)  Professionalism.

20

(ii)  Authority as a school security officer.

21

(iii)  Report writing.

22

(iv)  Self defense and dealing with unruly students and

23

adults.

24

(v)  Search and seizure on school property.

25

(vi)  Testifying in court.

26

(vii)  Working with State and local police agencies.

27

(viii)  Lockdown and crisis procedures.

28

(ix)  Interviewing witnesses.

29

(x)  Preserving evidence.

(xi)  The school code.

(xii)  Basic computer skills.

(xiii)  Custody issues specific to schools.

3

(xiv)  Crowd control.

4

(xv)  Special events security.

5

(xvi)  Drug identification.

6

(xvii)  Truancy and related issues.

(4)  In addition, a school officer must be certified in basic

8

first aid, cardiopulmonary resuscitation (CPR) and automated

9

external defibrillator (AED) usage.

10

(5)  The course shall include at least sixty (60) hours of

11

instruction.

12

(6)  Instructors for the required course material must be

13

accredited through one of the following:

14

(i)  The department.

15

(ii)  The Pennsylvania Commission on Crime and Delinquency.

16

(iii)  The provisions of 53 Pa.C.S. Ch. 21 Subch. D (relating

17

to municipal police education and training).

18

(iv)  The Pennsylvania State Police.

19

(7)  Instructors for any additional course material must be

20

approved by the board.

(b)  (1)  The board shall have the duty to adopt curriculum

22

that is in compliance with this act, to pay costs of

23

certification and recertification, but not for qualification for

24

training, to set the date and location of the certification and

25

recertification courses and to maintain and file with the

26

department a list of all certified security officers in the

27

district.

28

(2)  The department shall have the duty to approve all board-

29

adopted policies and the authority to promulgate rules and

30

regulations not inconsistent with this act and to issue

certification or recertification upon successful completion of

2

the mandated and approved training course.

(c)  A person who is certified under 53 Pa.C.S. § 2167

4

(relating to police training), 2168 (relating to automatic

5

certification) or 2169 (relating to in-service training by

6

existing personnel) shall be automatically certified by the

7

board.

8

(d)  To qualify for admission into a training course, the

9

individual must meet all the following:

10

(1)  Be eighteen (18) years of age or older.

11

(2)  Have a certified physician attest to the individual's

12

physical ability to perform the duties of a security officer.

13

(3)  Have on file with both the board and the department the

14

following:

15

(i)  A Federal Bureau of Investigation (FBI) clearance.

16

(ii)  Certification under section 111 relating to background

17

checks of perspective employes and conviction of employes of

18

certain offenses.

19

(iii)  Certification under 23 Pa.C.S. Ch. 63 Subch. C.2

20

(relating to background checks for employment in schools).

21

(e)  The department shall issue a certification to the

22

individual upon successful completion of the required training

23

course. The only ongoing requirement to keep the certification

24

valid shall be successful completion of the yearly twenty (20)

25

hour course. This course shall consist of updates to the basic

26

curriculum or specialized areas that the board deems necessary.

27

(f)  Nothing in this act shall require or prohibit a

28

centralized training or recertification course.

(g)  As used in this section:

"Board" means the board of school directors for a local

school district.

"Department" means the Department of Education of the

3

Commonwealth.

"District" means a school district located within this

5

Commonwealth.

6

"Security officer" means a person employed by a school

7

district for the purposes of maintaining the security of the

8

school. The term shall include school police officers hired

9

under section 778.

10

Section 2.  This act shall take effect in 60 days.
