        Introduced  by  Sen.  WEBB  --  read twice and ordered printed, and when
          printed to be committed to the Committee on Rules

        AN ACT to amend the education law, in relation to  physician  coursework
          or  training  in  nutrition;  and  to repeal section 264 of the public
          health law, relating to physician coursework or training in nutrition

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Section 264 of the public health law, as added by a chapter
     2  of  the  laws of 2023, amending the public health law relating to physi-
     3  cian coursework or training in nutrition,  as  proposed  in  legislative
     4  bills numbers S. 4401-A and A. 5985-A, is REPEALED.
     5    §  2.  The  education law is amended by adding a new section 6505-e to
     6  read as follows:
     7    § 6505-e. Provision of information related to coursework and  training
     8  in  nutrition. 1. The department, in consultation with the department of
     9  health, shall compile a list of continuing medical education courses and
    10  training opportunities regarding nutrition, which may include but not be
    11  limited to plant-based nutrition,  clinically  proven  methods  for  the
    12  prevention,  reversal,  and  treatment  of  diet-related  illnesses, and
    13  informational resources regarding racial  disparities  in  outcomes  for
    14  diet-related diseases, that are publicly available, and shall distribute
    15  such  compilation to physicians who are licensed to practice medicine in
    16  the state.
    17    2. The compiled list shall be made publicly available on  the  depart-
    18  ment's  website  and on the department of health's website, and shall be
    19  updated and redistributed no less frequently than every  two  years  via
    20  email.
    21    3.  In  compiling  such  resources,  the department shall consult with
    22  organizations representative of professions, and institutions of  higher
    23  education,  and  the  department of health shall consult with those with
    24  expertise in nutrition and the prevention, reversal,  and  treatment  of
    25  diet-related illnesses.
    26    §  3.  This  act  shall  take  effect on the same date and in the same
    27  manner as a chapter of the laws of 2023, amending the public health  law
    28  relating  to  physician coursework or training in nutrition, as proposed
    29  in legislative bills numbers S. 4401-A and A. 5985-A, takes effect.
