GIPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend chapter 524 of the laws of 1987, relating to establish- ing the Greater Poughkeepsie library district, in the city and town of Poughkeepsie, Dutchess county, in relation to the election of the trustees of such library THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 6 of chapter 524 of the laws of 1987, relating to 2 establishing the Greater Poughkeepsie library district, in the city and 3 town of Poughkeepsie, Dutchess county, as amended by chapter 361 of the 4 laws of 1997, is amended to read as follows: 5 S 6. The district shall be governed by a board of trustees consisting 6 of eleven trustees. The trustees of the Greater Poughkeepsie library 7 district as of the effective date of the chapter of the laws of 1997 8 which added this provision shall become trustees, immediately, of the 9 Poughkeepsie public library district. TRUSTEES ARE ELECTED BY PUBLIC 10 VOTE AT THE GENERAL ELECTION EACH NOVEMBER AND SHALL APPEAR ON THE 11 BALLOT AS PROVIDED BY THE DUTCHESS COUNTY BOARD OF ELECTIONS, AT NO 12 CHARGE TO THE DISTRICT. Seven of the trustees shall be elected [at an 13 election to be held] BY THE VOTERS within the town and four of the trus- 14 tees shall be elected [at an election to be held] BY THE VOTERS within 15 the portion of the district located in the city. The trustees elected 16 [at the election in] BY THE VOTERS OF the town must be QUALIFIED VOTERS 17 AND residents of the town and the trustees elected [in] BY THE VOTERS OF 18 the city must be QUALIFIED VOTERS AND residents of the city. NOMINATING 19 PETITIONS SHALL BE CIRCULATED AND FILED AT THE SAME TIME AS INDEPENDENT 20 PETITIONS, AS DETERMINED ANNUALLY BY THE NEW YORK STATE BOARD OF 21 ELECTIONS. A SEPARATE PETITION SHALL BE REQUIRED TO NOMINATE EACH CANDI- 22 DATE FOR A VACANCY ON THE BOARD. EACH PETITION SHALL BE SIGNED BY AT 23 LEAST TWENTY-FIVE QUALIFIED VOTERS OF THE CITY OR TOWN IN WHICH THE 24 VACANCY OCCURS. PETITIONS SHALL STATE THE RESIDENCE OF EACH SIGNER, AND 25 SHALL STATE THE NAME AND RESIDENCE OF THE CANDIDATE. The trustees shall 26 serve for a term of five years and until his or her successor is elected EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14735-01-4 S. 7085 2 1 and qualified. Two-thirds of the trustees shall constitute a quorum. 2 Action of the trustees shall require a two-thirds vote of the entire 3 board. Vacancies shall be filled by appointment by the trustees, 4 provided, however, that an election shall be held at the first available 5 general election day after the happening of a vacancy. The person or 6 persons appointed by the trustees shall serve until a successor is 7 elected and qualified as provided herein. Vacancies for trustees elected 8 within the city shall be filled by city residents and vacancies for 9 trustees elected within the town shall be filled by town residents. 10 S 2. This act shall take effect immediately.
