        Introduced  by  Sen.  CLEARE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Agriculture

        AN ACT to amend the general business law, in relation to establishing  a
          private right of action for milk price gouging

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 396-rr of the general business law  is  amended  by
     2  adding a new subdivision 7 to read as follows:
     3    7. (a) Any individual damaged by a violation of this section may bring
     4  an  action for recovery of damages. Judgment may be entered in an amount
     5  not to exceed three times the actual damages  plus  reasonable  attorney
     6  fees.
     7    (b) Nothing in this subdivision shall be construed so as to nullify or
     8  impair any right or rights which an individual may have against a person
     9  at common law, by statute, or otherwise.
    10    § 2. This act shall take effect immediately.
