     Requires State Comptroller to receive and provide certain independent authority employee information on State Comptroller's website.

An Act concerning the display of certain independent authority information by the State Comptroller and supplementing P.L.2007, c.52 (C.52:15C-1 et al.) and various parts of the statutory law amending the compacts and agreements concerning certain interstate authorities.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    As used in P.L.    , c.    (C.        ) (pending before the Legislature as this bill):

     "Authority" means an independent State authority, interstate authority, or local authority.

     "Compensation" means wages, salaries, commissions, or any other form of remuneration paid to officers or employees for personal services but shall not include supplemental compensation for accumulated unused sick leave.

     "Governmental affairs agent" shall have the same meaning as provided in section 3 of P.L.1971, c.183 (C.52:13C-20).

     "Independent State authority" means a public authority, board, commission, corporation, or other agency or instrumentality of the State allocated, in but not of, a principal department of State government pursuant to Article V, Section IV, paragraph 1 of the New Jersey Constitution, or which is not subject to supervision or control by the department in which it is allocated, and a regional authority, but shall not include a college or university.

     "Interstate authority" means the Port Authority of New York and New Jersey, the Delaware River Port Authority, the Delaware River and Bay Authority, and the Delaware River Joint Toll Bridge Commission.

     "Local authority" means an "authority" as defined under the "Local Authorities Fiscal Control Law," P.L.1983, c.313 (C.40A:5A-1 et seq.).

 

     2.    a.    In addition to any other duties and responsibilities prescribed by P.L.2007, c.52 (C.52:15C-1 et al.), the State Comptroller shall collect from every authority and every authority shall provide to the State Comptroller, within 60 days of the effective date of P.L.    , c.    (C.        ) (pending before the Legislature as this bill), and annually thereafter, the following information concerning the authority's most current and two prior fiscal years:

     (1)   the authority's revenues, expenses, and debts;

     (2)   the number of employees employed by the authority;

     (3)   the highest, lowest, and median annual compensation of the employees of the authority;

     (4)   the number of days of accumulated unused sick and vacation leave owed to the employees of the authority and the amount of any unfunded liability the authority has with respect to that unused sick and vacation leave;

     (5)   the highest, lowest, and median annual pension payments of former employees of the authority; and

     (6)   the name and amount of compensation paid to any governmental affairs agent hired by the authority.

     b.    The State Comptroller shall provide on the Internet website of the State Comptroller the information required to be provided, pursuant to section 2 of P.L.    , c.    (C.        ) (pending before the Legislature as this bill) by an authority, as the information becomes available from an authority.

 

     3.    a.    The Governor is authorized to enter into a supplemental compact or agreement, on behalf of the State of New Jersey, with the State of New York amending the compact of April 30, 1921, between the states of New York and New Jersey, as amended and supplemented, creating the Port Authority of New York and New Jersey to effectuate the provisions of P.L.    , c.    (C.        ) (pending before the Legislature as this bill).

     b.    The Governor is authorized to apply, on behalf of the State of New Jersey, to the Congress of the United States for its consent and approval to such supplemental compact or agreement, but in the absence of such consent and approval, the Port Authority of New York and New Jersey referred to in such supplemental compact or agreement shall have all of the powers which the State of New York and the State of New Jersey may confer upon it without the consent and approval of Congress.

     c.     The compact of April 30, 1921, between the states of New York and New Jersey, as amended and supplemented, creating the Port Authority of New York and New Jersey as heretofore amended and supplemented, is amended and supplemented by adding thereto, as a part thereof, a new provision reading as follows:

     The Port Authority of New York and New Jersey shall provide to the State Comptroller of New Jersey, within 60 days of the effective date of P.L.    , c.    (C.        ) (pending before the Legislature as this bill), and annually thereafter, the following information concerning the port authority's most current and two prior fiscal years:

     (1)   the port authority's revenues, expenses, and debts;

     (2)   the number of employees employed by the port authority;

     (3)   the highest, lowest, and median annual compensation of the employees of the port authority;

     (4)   the number of days of accumulated unused sick and vacation leave owed to the employees of the port authority and the amount of any unfunded liability the port authority has with respect to that unused sick and vacation leave;

     (5)   the highest, lowest, and median annual pension payments of former employees of the authority; and

     (6)   the name and amount of compensation paid to any governmental affairs agent hired by the port authority.

 

     4.    a.    The Governor is authorized to enter into a supplemental compact or agreement, on behalf of the State of New Jersey, with the Commonwealth of Pennsylvania supplementing the compact or agreement between the Commonwealth of Pennsylvania and the State of New Jersey entitled "Agreement Between the Commonwealth of Pennsylvania and the State of New Jersey creating the Delaware River Joint Commission as a body corporate and politic and defining its powers and duties," to effectuate the purposes of P.L.    , c.    (C.        ) (pending before the Legislature as this bill).

     b.    The Governor is authorized to apply, on behalf of the State of New Jersey, to the Congress of the United States for its consent and approval to such supplemental compact or agreement, but in the absence of such consent and approval, the commission referred to in such supplemental compact or agreement shall have all of the powers which the Commonwealth of Pennsylvania and the State of New Jersey may confer upon it without the consent and approval of Congress.

     c.     The "Agreement between the Commonwealth of Pennsylvania and the State of New Jersey creating the Delaware River Joint Commission as a body corporate and politic and defining its powers and duties," as heretofore amended and supplemented is amended and supplemented by adding thereto, as a part thereof, a new provision reading as follows:

     The Delaware River Port Authority shall provide to the State Comptroller of New Jersey, within 60 days of the effective date of P.L.    , c.    (C.        ) (pending before the Legislature as this bill), and annually thereafter, the following information concerning the port authority's most current and two prior fiscal years:

     (1)   the port authority's revenues, expenses, and debts;

     (2)   the number of employees employed by the port authority;

     (3)   the highest, lowest, and median annual compensation of the employees of the port authority;

     (4)   the number of days of accumulated unused sick and vacation leave owed to the employees of the port authority and the amount of any unfunded liability the port authority has with respect to that unused sick and vacation leave;

     (5)   the highest, lowest, and median annual pension payments of former employees of the port authority; and

     (6)   the name and amount of compensation paid to any governmental affairs agent hired by the port authority.

 

     5.    a.    The Governor is authorized to enter into a supplemental compact or agreement, on behalf of the State of New Jersey, with the Commonwealth of Pennsylvania amending the compact or agreement between the Commonwealth of Pennsylvania and the State of New Jersey entitled "Agreement between the State of New Jersey and the Commonwealth of Pennsylvania creating the Delaware River Joint Toll Bridge Commission as a body corporate and politic and defining its powers and duties," to effectuate of purposes of P.L.    , c.    (C.        ) (pending before the Legislature as this bill).

     b.    The Governor is authorized to apply, on behalf of the State of New Jersey, to the Congress of the United States for its consent and approval to such supplemental compact or agreement, but in the absence of such consent and approval, the commission referred to in such supplemental compact or agreement shall have all of the powers which the Commonwealth of Pennsylvania and the State of New Jersey may confer upon it without the consent and approval of Congress.

     c.     The "Agreement between the Commonwealth of Pennsylvania and the State of New Jersey creating the Delaware River Joint Toll Bridge Commission as a body corporate and politic and defining its powers and duties," as heretofore amended and supplemented, is amended and supplemented by adding thereto, as a part thereof, a new provision reading as follows:

     The Delaware River Joint Toll Bridge Commission shall provide to the State Comptroller of New Jersey, within 60 days of the effective date of P.L.    , c.    (C.        ) (pending before the Legislature as this bill), and annually thereafter, the following information concerning the commission's most current and two prior fiscal years:

     (1)   the commission's revenues, expenses, and debts;

     (2)   the number of employees employed by the commission;

     (3)   the highest, lowest, and median annual compensation of the employees of the commission;

     (4)   the number of days of accumulated unused sick and vacation leave owed to the employees of the commission and the amount of any unfunded liability the commission has with respect to that unused sick and vacation leave;

     (5)   the highest, lowest, and median annual pension payments of former employees of the commission; and

     (6)   the name and amount of compensation paid to any governmental affairs agent hired by the commission.

 

     6.    a.    The Governor is authorized to enter into a supplemental compact or agreement, on behalf of the State of New Jersey, with the State of Delaware amending the compact or agreement between the State of Delaware and the State of New Jersey known as the "Delaware-New Jersey Compact," to effectuate the provisions of P.L.    , c.    (C.        ) (pending before the Legislature as this bill).

     b.    The Governor is authorized to apply, on behalf of the State of New Jersey, to the Congress of the United States for its consent and approval to such supplemental compact or agreement, but in the absence of such consent and approval, the Delaware River and Bay Authority referred to in such supplemental compact or agreement shall have all of the powers which the State of Delaware and the State of New Jersey may confer upon it without the consent and approval of Congress.

     c.     The "Delaware-New Jersey Compact" as heretofore amended and supplemented, is amended and supplemented by adding thereto, as a part thereof, a new provision reading as follows:

     The Delaware River and Bay Authority shall provide to the State Comptroller of New Jersey, within 60 days of the effective date of P.L.    , c.    (C.        ) (pending before the Legislature as this bill), and annually thereafter, the following information concerning the authority's most current and two prior fiscal years:

     (1)   the authority's revenues, expenses, and debts;

     (2)   the number of employees employed by the authority;

     (3)   the highest, lowest, and median annual compensation of the employees of the authority;

     (4)   the number of days of accumulated unused sick and vacation leave owed to the employees of the authority and the amount of any unfunded liability the authority has with respect to that unused sick and vacation leave;

     (5)   the highest, lowest, and median annual pension payments of former employees of the authority; and

     (6)   the name and amount of compensation paid to any governmental affairs agent hired by the authority.

 

     7.    a.    Sections 1 and 2 of this act shall take effect immediately.

     b.    Sections 3 through 6 of this act shall take effect upon the enactment into law of legislation by the State of New York, the Commonwealth of Pennsylvania, or the State of Delaware, as appropriate, but if the other state already enacted such legislation, sections 3 through 6 of this act shall take effect immediately.

 

 

STATEMENT

 

     This bill empowers the State Comptroller to collect from every State and local government authority and the Port Authority of New York and New Jersey, the Delaware River Port Authority, the Delaware River and Bay Authority, and the Delaware River Joint Toll Bridge Commission, and requires these authorities to provide annually to the State Comptroller, certain information representing the most current and two prior fiscal years of these authorities.  Specifically, the information to be provided by an authority is to include:

     (1)   the authority's revenues, expenses, and debts;

     (2)   the number of employees employed by the authority;

     (3)   the highest, lowest, and median annual compensation of the employees of the authority;

     (4)   the number of days of accumulated unused sick and vacation leave owed to the employees of the authority and the amount of any unfunded liability the authority has with respect to that unused sick and vacation leave;

     (5)   the highest, lowest, and median annual pension payments of former employees of the authority; and

     (6)   the name and amount of compensation paid to any governmental affairs agent hired by the authority.

     The State Comptroller is to provide the required information on its Internet website as it becomes available from an authority.
