SYNOPSIS

     Establishes Kidney Donor Insurance Fund.

An Act concerning health insurance coverage for kidney donors and supplementing Title 17B of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  A person who donates a kidney as a live kidney donor shall be eligible after the donation for a health benefits plan through the New Jersey Individual Health Coverage Program pursuant to P.L.1992, c.161 (C.17B-27A-2 et seq.) for the duration of the donor's life.  A health benefits plan provided to a donor pursuant to this section shall include the highest level of services available through the gold level of the New Jersey Individual Health Coverage Program, and shall include prescription drug coverage.

     b.    The State shall be responsible for the payment of all premiums in connection with the health benefits plan and neither the donor nor the donor's employer shall be liable for the health benefits plan premium.  The plan premiums shall be paid for by the State from the Kidney Donor Insurance Fund established pursuant to section 2 of this act.

 

     2.    There is established a non-lapsing, revolving fund in the Department of Banking and Insurance to be known as the "Kidney Donor Insurance Fund."  This fund shall be the repository for monies received as grants in support of this act or moneys otherwise appropriated or directed to be remitted to this fund as are necessary to implement this act.  The purpose of the fund shall be to pay the health benefits plan premium costs for persons eligible as live kidney donors for coverage pursuant to section 1 of this act.

 

     3.    This act shall take effect immediately and shall apply to all live donor kidney donations made on or after the date of enactment.

 

 

STATEMENT

 

     This bill provides that a person who donates a kidney as a live kidney donor is to be eligible after the donation for a health benefits plan through the New Jersey Individual Health Coverage Program for the duration of the donor's life.  The health benefits plan is to be paid for by the State through the "Kidney Donor Insurance Fund," established pursuant to the bill in the Department of Banking and Insurance, and is to include the highest level of services available through the gold level of the New Jersey Individual Health Coverage Program.
