SYNOPSIS

     Prohibits retail dealers of motor fuels from requiring identification or proof of residency to purchase motor fuel or from refusing to sell motor fuel based on location of any person's residence.

An Act concerning retail dealers of motor fuels and supplementing chapter 6 of Title 56 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  No retail dealer shall:

     (1)   Require any person to display identification or proof of residency in order to purchase motor fuel; or

     (2)   Refuse to sell motor fuel to any person on the basis of the location of that person's place of residence.

     b.    This section may be suspended pursuant to the emergency powers granted to the Governor by section 15 of P.L.1977, c.146 (C.52:27F-17), on a finding that the suspension is necessary to alleviate an existing or impending energy supply shortage.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits retail dealers of motor fuels from requiring any person to display identification or proof of residency in order to purchase motor fuel, or refusing to sell motor fuel to any person on the basis of the location of that person's place of residence.  The provisions of the bill may be suspended pursuant to the emergency powers granted to the Governor, on a finding that the suspension is necessary to alleviate an existing or impending energy supply shortage.

     The bill is a response to reports of a motor fuel retail dealer who, in the aftermath of Superstorm Sandy, refused to sell motor fuel to people who did not live in the municipality where the motor fuel retail dealer's place of business was located.
