SYNOPSIS

     Provides that a school business administrator appointed by a school district after a certain date will not be eligible for tenure and may be dismissed pursuant to the terms of the employment contract.

An Act concerning school business administrators and supplementing chapter 17 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a. Notwithstanding the provisions of N.J.S.18A:17-1, N.J.S.18A:17-2, N.J.S.18A:17-14.1, N.J.S.18A:17-14.3, N.J.S.18A:28-5, or any other section of law to the contrary, a school business administrator appointed by a school district on or after the effective date of this act shall not be eligible to acquire tenure in that position.  The school business administrator shall receive an annual employment contract and may be dismissed by the board of education pursuant to the terms of that contract.

     b.    The State Board of Education shall promulgate rules pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), to effectuate the provisions of this act.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     Under current law a school business administrator employed by a school district is eligible to receive tenure in the same manner as teachers and certain other certificated employees employed in the district.  Under this bill school business administrators appointed by a school district after the effective date of the bill will no longer be eligible to acquire tenure.  A school business administrator hired after that date will be given an annual employment contract and may be dismissed pursuant to the terms of that contract.
