SYNOPSIS
Prohibits the construction of school facilities on a contaminated or remediated site.

An Act concerning the construction of public school district facilities and supplementing chapter 7G of Title 18A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. As used in this act:
"Other facilities" means athletic stadiums, swimming pools, any associated structures or related equipment tied to such facilities, including, but not limited to, grandstands and night field lights, greenhouses, garages, facilities used for non-instructional or non-educational purposes, and any structure, building, or facility used solely for school administration;
"School facility" means any structure, building, or facility used wholly or in part for educational purposes by a district or community provider, and facilities that physically support such structures, buildings, and facilities, such as district wastewater treatment facilities, power generating facilities, and steam generating facilities.
2. Notwithstanding any provision of law to the contrary, a district as defined in section 3 of P.L.2000, c.72 (C.18A:7G-3) shall not construct a school facility or other facility on any land on which there is contamination or on any land that has been subject to environmental remediation to address such contamination.
3. This act shall take effect immediately.
STATEMENT
This bill prohibits a school district from constructing a school facility or any other facility on land on which there is contamination or on any land that has been subject to environmental remediation to address such contamination. The construction of school facilities on such land is never appropriate, as the health of a school district's students and staff must always be the paramount concern.
