A BILL TO BE ENTITLED

AN ACT to transfer the fraud unit of the industrial commission to the department of insurance along with all appropriations made to that unit.

The General Assembly of North Carolina enacts:

SECTION 1. Pursuant to G.S. 143A‑6, the Fraud Unit operating within the Industrial Commission shall be transferred to the Department of Insurance as a Type II transfer, with the Fraud Unit intact. The Fraud Unit shall be administered under the direction and supervision of the Department of Insurance but shall exercise all its prescribed statutory powers independently of the head of that department. However, the management functions of the transferred unit shall be performed under the direction and supervision of the Commissioner of Insurance. The term "management functions" means planning, organizing, staffing, directing, coordinating, reporting, and budgeting.

SECTION 2. To implement this act, the Director of the Budget shall transfer all appropriations made to the Fraud Unit of the Industrial Commission to the Fraud Unit of the Department of Insurance.

SECTION 3. This act becomes effective July 1, 2012.
