AN ACT

To amend chapter 26, RSMo, by adding thereto one new section relating to racial and gender equity in the membership of boards, commissions, committees, and councils.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 26, RSMo, is amended by adding thereto one new section, to be known as section 26.103, to read as follows:

            26.103. 1. The governor shall maintain and regularly update a listing of each state appointive board, commission, committee, and council having members appointed by the governor. The listing shall include each appointee's name, city or county of residence, race, gender, and the expiration date of each appointee's term. The executive officer, director, or chair of each state appointive board, commission, committee, and council having members appointed by the governor shall electronically report such information to the office of the governor no later than May 31, 2014, and annually thereafter. The governor shall receive and maintain the reports submitted under this subsection as public records and all information received under this subsection except information relating to race and gender shall be posted on the governor's website.

            2. The governor shall maintain and provide upon request a listing of the composition of each state appointive board, commission, committee, and council with respect to race, gender, geographic location, and the expiration date of each appointee's term no later than May 31, 2015. Any person may request a listing under this subsection for any combination of boards, commissions, committees and councils as determined by the person making the request so that such person can see the composition of such entities under this subsection. No listing created under this subsection shall include the name or other personal identifying information of any member of such board, commission, committee, or council.

            3. No provision of this section shall prohibit an individual from completing a term as a member of a state appointive board, commission, committee, or council or create a private right of action.
