A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding sections 17011b and 17511b.

the people of the state of michigan enact:

Sec. 17011b. Notwithstanding section 17011, this part does not prohibit an individual licensed as an esthetician or cosmetologist under article 12 of the occupational code, 1980 PA 299, MCL 339.1201 to 339.1218, from performing activities described in section 1210 of the occupational code, 1980 PA 299, MCL 339.1210, that are considered the practice of medicine, if those activities are within the individual's scope of practice and the individual does not use the words, titles, or letters protected under section 17011.

Sec. 17511b. Notwithstanding section 17511, this part does not prohibit an individual licensed as an esthetician or cosmetologist under article 12 of the occupational code, 1980 PA 299, MCL 339.1201 to 339.1218, from performing activities described in section 1210 of the occupational code, 1980 PA 299, MCL 339.1210, that are considered the practice of osteopathic medicine and surgery, if those activities are within the individual's scope of practice and the individual does not use the words, titles, or letters protected under section 17511.

Enacting section 1. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 5684 (request no. 04129'23) of the 102nd Legislature is enacted into law.
