HOUSE BILL NO. 4588

May 16, 2023, Introduced by Reps. Aragona and Bierlein and referred to the Committee on Government Operations.

A bill to amend 1939 PA 176, entitled

"An act to create a commission relative to labor disputes, and to prescribe its powers and duties; to provide for the mediation and arbitration of labor disputes, and the holding of elections thereon; to regulate the conduct of parties to labor disputes and to require the parties to follow certain procedures; to regulate and limit the right to strike and picket; to protect the rights and privileges of employees, including the right to organize and engage in lawful concerted activities; to protect the rights and privileges of employers; to make certain acts unlawful; to make appropriations; and to prescribe means of enforcement and penalties for violations of this act,"

(MCL 423.1 to 423.30) by adding section 8a.

the people of the state of michigan enact:

Sec. 8a. (1) A labor organization shall not use dues or fees collected from an employee for a political purpose unless both of the following conditions are met:

(a) The employee gives the labor organization explicit authorization, in writing, to use the employee's dues or fees for a political purpose.

(b) The employee has not revoked the employee's authorization.

(2) A labor organization shall maintain an employee's written authorization under subsection (1) until the later of the following:

(a) One year after the date the employee is no longer a member of the labor organization.

(b) One year after the date the employee is no longer a member of the bargaining unit that the labor organization represents.

(c) One year after the date the employee revokes the employee's authorization.

(3) As used in this section, "political purpose" means support for or opposition to any of the following:

(a) A ballot question or ballot question committee as those terms are defined in section 2 of the Michigan campaign finance act, 1976 PA 388, MCL 169.202.

(b) A political committee, political party, or political party committee as those terms are defined in section 11 of the Michigan campaign finance act, 1976 PA 388, MCL 169.211.
