Bill Title: Amends the Illinois Procurement Code. Provides that, in awarding State contracts requiring the procurement of motor fuel, preference may be given to an otherwise qualified bidder or offeror who will fulfill the contract through the use of fuel produced at an Illinois renewable fuel plant, provided that the cost included in the bid of motor fuel produced at an Illinois renewable fuel plant is not more than 1% greater than the average cost of motor fuel not produced at an Illinois renewable fuel plant. Effective January 1, 2013.

SYNOPSIS AS INTRODUCED:
30 ILCS 500/45-62 new

Amends the Illinois Procurement Code. Provides that, in awarding State contracts requiring the procurement of motor fuel, preference may be given to an otherwise qualified bidder or offeror who will fulfill the contract through the use of fuel produced at an Illinois renewable fuel plant, provided that the cost included in the bid of motor fuel produced at an Illinois renewable fuel plant is not more than 1% greater than the average cost of motor fuel not produced at an Illinois renewable fuel plant. Effective January 1, 2013.

1 AN ACT concerning finance.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Procurement Code is amended by
5adding Section 45-62 as follows:
6 (30 ILCS 500/45-62 new)
7 Sec. 45-62. Illinois agricultural commodity-based fuel. In
8awarding contracts requiring the procurement of motor fuel,
9preference may be given to an otherwise qualified bidder or
10offeror who will fulfill the contract through the use of motor
11fuel produced at an Illinois renewable fuel plant, provided
12that the cost included in the bid of motor fuel produced at an
13Illinois renewable fuel plant is not more than 1% greater than
14the average cost of motor fuel not produced at an Illinois
15renewable fuel plant.
16 For purposes of this Section:
17 "Motor fuel" has the same meaning as in Section 1.1 of the
18Motor Fuel Tax Law.
19 "Plant" has the same meaning as in Section 10 of the
20Illinois Renewable Fuels Development Program Act.
21 "Renewable fuel" has the same meaning as in Section 10 of
22the Illinois Renewable Fuels Development Program Act.

1 Section 99. Effective date. This Act takes effect January
21, 2013.
