Bill Title: Creates the Small Single-Use Plastic Bottle Act. Provides that, beginning July 1, 2025, hotels with 50 rooms or more and, beginning January 1, 2026, hotels with less than 50 rooms may not provide small single-use plastic bottles containing personal care products to either (i) a customer of the establishment who is staying in a sleeping room accommodation or any space within the sleeping room accommodation or (ii) a customer of the establishment who is using a bathroom shared by the public or guests. Establishes civil penalties. Defines terms.

1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the Small
5Single-Use Plastic Act.
6 Section 5. Definitions. As used in this Act:
7 "Hotel" has the meaning given in the Hotel Operators'
8Occupation Tax Act.
9 "Personal care products" includes shampoo, hair
10conditioner, and bath soap intended to be applied to or used on
11the human body in the shower or bath.
12 "Small, single-use plastic bottle" means a plastic bottle
13or container with less than a 6-ounce capacity that is
14intended to be nonreusable by the end user.
15 Section 10. Small, single-use plastic bottles at hotels.
16 (a) Beginning July 1, 2025, a hotel with 50 rooms or more
17shall not provide small, single-use plastic bottles containing
18personal care products in any space within a sleeping room
19accommodation, within bathrooms shared by the public or
20guests, or to a customer of the establishment staying in a
21sleeping room accommodation.
22 (b) Beginning January 1, 2026, a hotel shall not provide

1small, single-use plastic bottles containing personal care
2products in any space within a sleeping room accommodation,
3within bathrooms shared by the public or guests, or to a
4customer of the establishment staying in a sleeping room
5accommodation.
6 (c) A hotel may provide personal care products in small,
7single-use plastic bottles to a person at no cost, upon
8request, at a place other than a sleeping room accommodation,
9a space within the sleeping room accommodation, or a space
10within bathrooms shared by the public or guests.
11 (d) A unit of local government, including a home rule
12unit, shall not regulate the provision of small, single-use
13plastic bottles in a manner inconsistent with the regulation
14by the State of the provision of small, single-use plastic
15bottles under this Act. This Section is a limitation under
16subsection (i) of Section 6 of Article VII of the Illinois
17Constitution on the concurrent exercise by home rule units of
18powers and functions exercised by the State.
19 Section 15. Civil penalties.
20 (a) A hotel in violation of this Act shall receive a
21written warning for the first violation from a State's
22Attorney or a municipal attorney. The written warning shall
23recite the violation and advise that subsequent violations may
24result in citations and penalties. Upon a second or subsequent
25violation, the hotel may be liable for a civil penalty of $500
