Bill Title: Amends the State Finance Act. In a Section permitting the Governor to reduce the amount of funds appropriated for statutory mandates to accommodate budgetary limitations, provides that the Section does not apply to funds appropriated under the State Pension Funds Continuing Appropriation Act. Effective immediately.

1 | AN ACT concerning finance.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The State Finance Act is amended by changing | ||||||||||||||||||||||||
5 | Section 25.2 as follows:

6 | (30 ILCS 105/25.2) | ||||||||||||||||||||||||
7 | Sec. 25.2. Statutory mandates not designated in law as | ||||||||||||||||||||||||
8 | being subject to appropriation. Notwithstanding any law to the | ||||||||||||||||||||||||
9 | contrary, from the effective date of this Section through | ||||||||||||||||||||||||
10 | fiscal year 2015, with respect to any statutory mandate that is | ||||||||||||||||||||||||
11 | not designated in law as being subject to appropriation, if and | ||||||||||||||||||||||||
12 | only if the Governor determines that funds appropriated for | ||||||||||||||||||||||||
13 | such statutory mandates are insufficient to satisfy those | ||||||||||||||||||||||||
14 | mandates, the Governor may reduce the amount of funds | ||||||||||||||||||||||||
15 | appropriated for some or all of those statutory mandates in | ||||||||||||||||||||||||
16 | amounts he or she deems necessary to accommodate budgetary | ||||||||||||||||||||||||
17 | limitations while attempting to implement such mandates to the | ||||||||||||||||||||||||
18 | extent reasonably practical. The reduction shall become | ||||||||||||||||||||||||
19 | effective upon the Governor giving notice of the reduction to | ||||||||||||||||||||||||
20 | the Speaker of the House of Representatives, the President of | ||||||||||||||||||||||||
21 | the Senate, the Minority Leader of the House of | ||||||||||||||||||||||||
22 | Representatives, the Minority Leader of the Senate, the State | ||||||||||||||||||||||||
23 | Comptroller, the State Treasurer, and the Commission on |

1 | Government Forecasting and Accountability. Nothing in this | ||||||
2 | Section prohibits adjustments to the Governor's reduction by | ||||||
3 | law. This Section does not apply to funds appropriated under | ||||||
4 | the State Pension Funds Continuing Appropriation Act.
