  3    nonpublic schools and including effective date and
  4    applicability provisions.

  1  1    Section 1.  Section 280.23, Code 2016, is amended to read as
  1  2 follows:
  1  3    280.23  Student health services ==== athletic trainers.
  1  4    1.  The board of directors of each public school district
  1  5 and the authorities in charge of each nonpublic school shall
  1  6 not require nonadministrative personnel to perform any special
  1  7 health services or intrusive nonemergency medical services for
  1  8 students unless the nonadministrative personnel are licensed or
  1  9 otherwise qualified and have consented to perform the services.
  1 10    2.  The board of directors of each school district and the
  1 11 authorities in charge of each nonpublic school shall have a
  1 12 contractual relationship with at least one athletic trainer
  1 13 licensed under chapter 152D.
  1 14    Sec. 2.  STATE MANDATE FUNDING SPECIFIED.  In accordance
  1 15 with section 25B.2, subsection 3, the state cost of requiring
  1 16 compliance with any state mandate included in this Act shall
  1 17 be paid by a school district from state school foundation aid
  1 18 received by the school district under section 257.16.  This
  1 19 specification of the payment of the state cost shall be deemed
  1 20 to meet all of the state funding=related requirements of
  1 21 section 25B.2, subsection 3, and no additional state funding
  1 22 shall be necessary for the full implementation of this Act
  1 23 by and enforcement of this Act against all affected school
  1 24 districts.
  1 25    Sec. 3.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  1 26 immediate importance, takes effect upon enactment.
  1 27    Sec. 4.  APPLICABILITY.  This Act applies to school years
  1 28 beginning on or after July 1, 2016.
  1 29                           EXPLANATION
  1 30 The inclusion of this explanation does not constitute agreement with
  1 31 the explanation's substance by the members of the general assembly.
  1 32    This bill requires each school district and each accredited
  1 33 nonpublic school to have a contractual relationship with at
  1 34 least one licensed athletic trainer.
  1 35    The bill may include a state mandate as defined in Code
  2  1 section 25B.3.  The bill requires that the state cost of
  2  2 any state mandate included in the bill be paid by a school
  2  3 district from state school foundation aid received by the
  2  4 school district under Code section 257.16.  The specification
  2  5 is deemed to constitute state compliance with any state mandate
  2  6 funding=related requirements of Code section 25B.2.  The
  2  7 inclusion of this specification is intended to reinstate the
  2  8 requirement of political subdivisions to comply with any state
  2  9 mandates included in the bill.
  2 10    The bill takes effect upon enactment and applies to school
  2 11 years beginning on or after July 1, 2016.
