A BILL FOR AN ACT

 

 

proposing AN amendment to article III of the constitution of the state of hawaii for initiative.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose amendments to article III of the Constitution of the State of Hawaii to provide for initiative. The legislature finds that no method exists for initiative in Hawaii and that this political mechanism would be in the best interest of Hawaii.  This Act is self-executing, but the legislature may enact legislation to facilitate its operation, including the timing and manner of an initiative; provided that the legislation may not restrict or limit the provisions of this section or the powers reserved in this section.

     SECTION 2.  Article III of the Constitution of the State of Hawaii is amended by adding a new section to be appropriately designated and to read as follows:

     Section  . Initiative. The initiative power shall be reserved to the people.       

SECTION 3.  The question to be printed on the ballot shall be as follows:

    "Shall the State Constitution be amended to specify that the initiative power shall be reserved to the people?"

     SECTION 4.  Statutory material to be repealed is bracketed. New statutory material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Hawaii Constitution.
